TALLAHASSEE, Fla. (WCTV) – Florida Attorney General James Uthmeier is officially calling for the impeachment of Judge Tiffany Baker-Carper, he announced Tuesday afternoon. <\/p>\n
The announcement comes after Governor Ron DeSantis signed Missy\u2019s Law<\/a>, which limits judge\u2019s discretion for violent offenders awaiting sentencing. <\/p>\n Judge Baker-Carper presides over Daniel Spencer\u2019s case. Spencer is accused of killing his stepdaughter, Missy Mogle, while out on bond for crimes related to meeting a minor for sex.<\/p>\n Uthmeier sent a letter to Florida House Speaker Daniel Perez, asking for him to being impeachment proceedings.<\/p>\n \u201cThis legislation vastly improves Florida criminal procedure to prevent judged from putting social justice over criminal justice,\u201d Uthmeier wrote. \u201cBut, the people of Florida demand accountability for judges\u2014like the judge responsible for letting Missy\u2019s killer remain free\u2014who grossly abuse their discretion by inexplicably refusing to take custody of convicted child sex predators, allowing them to continue preying on our children.\u201d <\/p>\n The letter continues to detail the murder of Missy Mogle<\/a>, a five-year-old girl from Tallahassee. <\/p>\n On April 15, 2025, Spencer was convicted of traveling to engage in unlawful sexual conduct with a child, according to the letter. Judge Baker-Carper allowed Spencer to remain on bond while sentencing for that case was pending. <\/p>\n Spencer is accused of killing Missy while out on bond. <\/p>\n \u201cJudge Baker-Carper\u2019s decision that allowed Spencer, a convicted child predator to remain on bond is why Missy is dead today,\u201d Uthmeier wrote. \u201cThis decision wasn\u2019t just disgraceful, reckless, and unthinkable; it rises to the level of a \u2018misdemeanor in office.\u2019\u201d<\/p>\n Florida law says a judge is liable to impeachment for misdemeanor in office and the speaker of the house of representatives can appoint a committee to investigate charges against any officer subject to impeachment. <\/p>\n \u201cJudge Baker-Carper\u2019s actions brought disrepute upon the judiciary,\u201d Uthmeier wrote. \u201cBut despite the obvious danger and warnings, Judge Baker-Carper let Spencer remain free, causing the untimely, violent murder of Missy.\u201d <\/p>\n WCTV reached out to the Trial Court Administrator for the Second Judicial Court for comment about the call for Judge Baker-Carper\u2019s impeachment. <\/p>\n They said judges and court administration are prohibited from commenting on pending cases.<\/p>\n To keep up with the latest news as it develops, follow WCTV on Facebook<\/a>, Instagram<\/a>, YouTube<\/a>, Nextdoor<\/a> <\/a>and X<\/a> (Twitter<\/a>).<\/p>\n Have a news tip or see an error?
