{"id":243026,"date":"2026-04-23T09:42:13","date_gmt":"2026-04-23T09:42:13","guid":{"rendered":"https:\/\/www.newsbeep.com\/us-fl\/243026\/"},"modified":"2026-04-23T09:42:13","modified_gmt":"2026-04-23T09:42:13","slug":"florida-wants-to-bar-undocumented-immigrant-students-from-public-colleges","status":"publish","type":"post","link":"https:\/\/www.newsbeep.com\/us-fl\/243026\/","title":{"rendered":"Florida wants to bar undocumented immigrant students from public colleges"},"content":{"rendered":"<p>Students applying to Florida&#8217;s public colleges will have to show proof they are U.S. citizens or legally in the country if a proposed policy goes through. <\/p>\n<p>The <a href=\"https:\/\/flrules.org\/gateway\/View_Notice.asp?id=30778602\" class=\"Link\" target=\"_blank\" rel=\"nofollow noopener\">policy will require<\/a> applicants to &#8220;provide clear and convincing documentation that he or she is a citizen of the United States or lawfully present in the United States prior to being granted admission to the institution.&#8221;<\/p>\n<p>Another part of the rule allows state colleges to \u201cdeny admission or enrollment to an applicant because of misconduct if determined to be in the best interest of the Florida College System institution.\u201d<\/p>\n<p>The Department of Education is proposing the change after <a href=\"https:\/\/www.wusf.org\/politics-issues\/2026-04-16\/florida-seeks-to-bar-undocumented-immigrants-from-state-colleges\" class=\"Link\" target=\"_blank\" rel=\"nofollow noopener\">state lawmakers failed<\/a> to pass <a href=\"https:\/\/www.floridapolicy.org\/posts\/sb-1052-and-hb-1279s-bans-are-harsh-limiting-higher-education-enrollment-and-financial-support-for-immigrants\" class=\"Link\" target=\"_blank\" rel=\"nofollow noopener\">similar restrictions<\/a> for public universities this past legislative session. <\/p>\n<p>Nor\u00edn Dollard is the senior policy analyst for the Florida Policy Institute, a nonpartisan think tank. Dollard said without a law, the state could be overstepping.<\/p>\n<p>ALSO READ: <a href=\"https:\/\/www.wusf.org\/politics-issues\/2026-04-16\/florida-seeks-to-bar-undocumented-immigrants-from-state-colleges\" class=\"Link\" rel=\"nofollow noopener\" target=\"_blank\">Florida seeks to bar undocumented immigrants from state colleges<\/a><\/p>\n<p>&#8220;Rule is not intended to create policy, a rule is intended to implement policy,&#8221; said Dollard.<\/p>\n<p>She <a href=\"https:\/\/www.leg.state.fl.us\/statutes\/index.cfm?App_mode=Display_Statute&amp;Search_String=1001.02&amp;URL=0100-0199\/0120\/Sections\/0120.536.html\" class=\"Link\" target=\"_blank\" rel=\"nofollow noopener\">cited Florida law<\/a> stating &#8220;an agency may adopt only rules that implement or interpret the specific powers and duties granted by the enabling statute.&#8221;<\/p>\n<p>If the policy goes into effect, the Florida Policy Institute estimates the Florida College System could lose <a href=\"https:\/\/www.floridapolicy.org\/posts\/ending-tuition-fairness-would-be-a-costly-mistake----for-families-and-floridas-higher-education-institutions\" class=\"Link\" target=\"_blank\" rel=\"nofollow noopener\">about $15 million<\/a> in tuition revenue. <\/p>\n<p>At the same time, <a href=\"https:\/\/edr.state.fl.us\/content\/conferences\/communitycolleges\/ExecutiveSummary.pdf\" class=\"Link\" target=\"_blank\" rel=\"nofollow noopener\">enrollment at public colleges<\/a> is still rebounding to pre-pandemic levels. <\/p>\n<p>&#8220;It seems a strange choice that we&#8217;re going to turn down revenue when we are still not serving all the students that we could,&#8221; said Dollard.<\/p>\n<p>The state&#8217;s public colleges operate with <a href=\"https:\/\/www.leg.state.fl.us\/statutes\/index.cfm?App_mode=Display_Statute&amp;Search_String&amp;URL=1000-1099\/1004\/Sections\/1004.65.html#:~:text=Florida%20College%20System%20institutions%20shall%2C%20as%20open%2Daccess%20institutions%2C,for%20full%20participation%20in%20society.\" class=\"Link\" target=\"_blank\" rel=\"nofollow noopener\">open-door admissions<\/a>, meaning all applicants with a high school diploma or GED are accepted. <\/p>\n<p>ALSO READ: <a href=\"https:\/\/www.wusf.org\/education\/2026-03-02\/tuition-florida-undocumented-college-students-tripled-how-are-they-doing-now\" class=\"Link\" rel=\"nofollow noopener\" target=\"_blank\">Tuition for Florida&#8217;s undocumented college students tripled last year. How are they doing now?<\/a><\/p>\n<p>Dollard said the policy would undermine the accessibility to higher education state colleges are supposed to provide. <\/p>\n<p>&#8220;Fundamentally, on humanitarian grounds, everyone deserves to be educated, and we as a society benefit from a well-educated, well-trained workforce,&#8221; Dollard said. <\/p>\n<p>A <a href=\"https:\/\/flrules.org\/gateway\/View_Notice.asp?id=30750084\" class=\"Link\" target=\"_blank\" rel=\"nofollow noopener\">separate rule<\/a> the Department of Education is considering could further restrict undocumented immigrants&#8217; access to higher education.
