Fatma Haiderzad / Facebook

The condo lawsuit is brought by Sphere Mia, a company owned by the foreign investor which actually bought the condo, and claims Birkmeir misrepresented it was he who bought the property for himself, rather than the Sphere.

The defendants — Haiderzad, real estate firm BRG International and its CEO Matias Alem — are accused of breach of statutory duty and fraudulent concealment among other charges.

Sphere claim that Birkmeir, who isn’t a party in the lawsuit, BRG and Alem, “grossly inflated” the price of the condo so the latter two got a higher commission.

Rather than the usual three percent, the higher price meant they got six percent.

In December last year, a unit one floor above the condo sold for $5.7 million — $500,000 less than the $6.2 million paid by Sphere, after years of increasing prices in the property market.

Birkmeir on a yacht in an unknown location. Alexis Read

Sources told The Post Sphere was approached by Birkmeir to buy the property as an investment and that they trusted him, so did not question the valuation.

However, at some point Sphere discovered not only the price been inflated, but also Haiderzad had been living in the condo without their knowledge.

The lawsuit states: “After the Turnberry Condo was purchased by Sphere Mia, instead of renting the property to offset costs and/or generate recurring revenue, Birkmeir arranged for defendant Haiderzad to occupy the apartment on a full-time basis for two years, making no rent payments to Sphere Mia as compensation for the fair value of the use of the property.

“Plaintiff seeks to recover from Haiderzad damages in an amount equal to the reasonable value of rent she should have paid during the two years she occupied the luxury condominium.”

Attempts by The Post to reach Haiderzad were unsuccessful. A lawyer for Alem told The Post: “There is no truth or merit to the allegations directed to my clients, BRG International LLC and Matias Alem.”

Birkmeir is said to have paid “expenses and maintenance associated with the unit,” according to the lawsuit.

Alem’s lawyers have also filed to dismiss the suit, saying it does not involve them, however, it currently remains active.
