Suarez was considered to be a Carollo loyalist, having worked as Carollo\u2019s chief of staff in City Hall from 2019 to 2022. Carollo, as Bayfront Park chairman, later brought on Suarez as the agency\u2019s executive director in March 2024.<\/p>\n<p>Suarez <a target=\"_blank\" rel=\"Follow nofollow noopener\" href=\"https:\/\/www.miamiherald.com\/news\/local\/community\/miami-dade\/article297303684.html\">abruptly resigned<\/a> his position as executive director in December 2024. He filed suit the next month, with representation from two attorneys who were well-acquainted with Carollo: Jay Rhodes, who previously worked as Carollo\u2019s senior policy adviser, and Jeff Gutchess, who has for years <a target=\"_blank\" rel=\"Follow nofollow noopener\" href=\"https:\/\/www.miamiherald.com\/news\/local\/community\/miami-dade\/little-havana\/article281641233.html\">been involved in Carollo-related litigation<\/a>.<\/p>\n<p>\u201cThe parties in this case, and their counsel, and their insurers, all worked together on a sensible resolution in the interests of the plaintiff, Mr. Suarez, the Bayfront Trust, and the residents of the City of Miami,\u201d Gutchess said in a statement Wednesday. \u201cThis is the way the legal process should work, and we hope to see more of this in the future.\u201d<\/p>\n<p>                                          <img decoding=\"async\" class=\"responsive-image\" loading=\"lazy\" src=\"https:\/\/www.newsbeep.com\/us-fl\/wp-content\/uploads\/2026\/05\/MIA_BAYFRONTPARKLAWSUIT0237.jpeg\"   width=\"1200\" height=\"800\" title=\"MIA_BAYFRONTPARKLAWSUIT0237\" alt=\"Jose Canto, left, the former finance director of the Bayfront Park Management Trust, and Jose Suarez, right, the former executive director of the Trust, appear during a press conference at AXS Law on Jan. 22, 2025. Carollo, however, said it is \u201cnot a huge amount\u201d and that it was a business decision by the insurance company for the defendants to settle. Carollo has denied the lawsuit\u2019s claims from the start.<\/p>\n<p>The city hired outside counsel to represent Carollo in the case. His legal team included former Miami City Commissioner Marc Sarnoff.<\/p>\n<p>\u201cI was very much wanting this to go forward,\u201d Carollo said Wednesday, adding that: \u201cThis lawsuit was the most frivolous lawsuit with no merit whatsoever.\u201d<\/p>\n<p>Carollo pointed to Gutchess\u2019 position as the attorney for Little Havana businessmen Bill Fuller and Martin Pinilla, who successfully sued Carollo when a jury in 2023 found him liable for weaponizing city resources against them in retaliation for their support of Carollo\u2019s political opponent in the 2017 election.<\/p>\n<p>Fuller and Pinilla are also plaintiffs in an ongoing lawsuit against the city that has similar allegations to that case. Carollo alleged that Suarez\u2019s lawsuit was an attempt to gain leverage in Fuller and Pinilla\u2019s ongoing case against the city, referring to Suarez as an \u201cindividual with no loyalty to anything but his pocketbook.\u201d<\/p>\n<p>In the whistleblower complaint, Suarez and former Bayfront Park Management Trust finance director Jose Canto accused Carollo of retaliation.<\/p>\n<p>The pair alleged that they were forced out of Bayfront Park after making \u201cunsettling discoveries\u201d as they set out to right the ship in an agency that, in addition to maintaining Bayfront Park and Maurice Ferr\u00e9 Park, generates revenue from hosting large-scale events, including Ultra Music Festival. Nevertheless, the lawsuit said Bayfront Park Management Trust lacked a proper accounting system and didn\u2019t have requirements for expenses to be supported by a contract or invoice policy, nor a policy or procedure to ensure vendors were selected through a competitive bidding process.<\/p>\n<p>They also accused Carollo of paying a TV station owned by \u201cclose personal friends\u201d to broadcast Bayfront Park\u2019s annual New Year\u2019s Eve event, storing cash parking payments in an easily accessible \u201cmoney room\u201d that was prone to theft, and supporting the purchase of a \u201csuspicious\u201d mobile veterinary truck. Carollo called the allegations \u201coutrageous.\u201d<\/p>\n<p>In March of this year, a judge dismissed the case without prejudice, allowing the plaintiffs to re-file. SAM NAVARRO                                                                            Special for the Miami Herald                                                                                        <\/p>\n<p>Suarez\u2019s lawsuit preceded Carollo\u2019s <a target=\"_blank\" rel=\"Follow nofollow noopener\" href=\"https:\/\/www.miamiherald.com\/news\/local\/community\/miami-dade\/article300281909.html\">removal as chairman<\/a> of Bayfront Park Management Trust weeks later, in February 2025. District 1 Commissioner Miguel Angel Gabela \u2014 a Carollo rival \u2014 replaced him and has remained in the role of chairman since.<\/p>\n<p>Carollo left elected office in December after reaching term limits following two consecutive terms on the City Commission.
