Months after police said a Hialeah woman died from ingesting cocaine, the husband who allegedly gave her the drugs is facing a murder charge, records show.<\/p>\n

Rafael Lujan, 37, was arrested Tuesday on charges of first-degree murder\/cocaine and cocaine possession, an arrest report showed.<\/p>\n

According to the report, On May 28, Hialeah Police responded to a home in the 3500 block of W. 89th Place for an unresponsive female.<\/p>\n

Officers met with her husband, Lujan, and in the home found a bag of cocaine, the report said.<\/p>\n

The victim, who wasn’t named in the report, was taken to Palmetto Hospital, where she died on June 1.<\/p>\n

The report said her blood later tested positive for cocaine, and the Miami-Dade Medical Examiner determined her cause of death as “acute combined drug (cocaine, ethanol) toxicity.”<\/p>\n

“Based on the fact of the defendant’s unlawful distribution of the cocaine to the victim caused her death, the defendant was arrested and charged accordingly,” the report said.<\/p>\n

Lujan was booked into jail and appeared before a judge on Wednesday.<\/p>\n

“So he purchased cocaine, consumed it with his wife, who later passed away as a result of an overdose,” a prosecutor said during the appearance.<\/p>\n

“That’s a novel theory,” Judge Mindy Glazer responded.<\/p>\n

Glazer questioned whether the charge should be first-degree murder or felony murder, but ultimately ordered Lujan held without bond.<\/p>\n

As cited in court, under Florida law, distributing a controlled substance that leads to death can be charged as first-degree felony murder, which is considered a capital felony.<\/p>\n
