MIAMI \u2014 Renderings for the proposed Trump Presidential Library reveal a massive project planned for land gifted to the Trump Presidential Library Foundation by the state and Miami Dade College.<\/p>\n
\u201cBut the problem here is not the library,\u201d attorney Gerald Greenberg said. \u201cThe problem here is your personal business for personal gain and that\u2019s unlawful.\u201d<\/p>\n
Greenberg represents a group of Miami residents — including a student, nearby neighbors and a nonprofit connected to Marvin Dunn — suing over what they describe as a land giveaway.<\/p>\n
The plaintiffs claim the land, owned by Miami-Dade College, was illegally gifted to President Donald Trump. The lawsuit cites the domestic emoluments clause of the U.S. Constitution.<\/p>\n
\u201cThe domestic emoluments clause says the president can\u2019t get gifts from states,\u201d Greenberg said. \u201cThis is a quintessential gift from a state. Miami-Dade College transferred the land to the state of Florida and the state of Florida transferred the land to the president.\u201d<\/p>\n
The site next to Miami\u2019s Freedom Tower is valued at around $67 million. But the lawsuit argues the land the project would sit on is worth hundreds of millions of dollars.<\/p>\n
In comments from March, Trump said the project would \u201cmost likely be a hotel.\u201d<\/p>\n
\u201cIt\u2019s most likely going to be a hotel with a beautiful building underneath and a 747 Air Force One in the lobby, which is going to be a trick,\u201d Trump said.<\/p>\n
The 57-page lawsuit states the land \u201cis no longer available to serve MDC\u2019s student community and downtown Miami.\u201d<\/p>\n
Instead, the filing states, \u201cthe land will house a Trump hotel that brings riches to the president.\u201d<\/p>\n
When asked whether critics would view the lawsuit as politically motivated, Greenberg rejected the idea.<\/p>\n
\u201cYeah, this isn\u2019t a politically motivated lawsuit at all,\u201d Greenberg said. \u201cThis is about giving public land to a private individual or in this case a president for his own private gain.\u201d<\/p>\n
