JACKSONVILLE, Fla. \u2014 A Jacksonville couple is without a set of wheels after their car was stolen last September.<\/p>\n
But at this point, it\u2019s not the thieves who won\u2019t give it back. It\u2019s the authorities. <\/p>\n
Diane Anglin went to her car on September 8th of last year, only to find it was nowhere to be seen.<\/p>\n
\u201cI\u2019m like, I parked it right there! It\u2019s not there!\u201d said Anglin.<\/p>\n
She reported the vehicle, a 2012 Mercedes 350 SUV, stolen and got a copy of the report from JSO.<\/p>\n
Fast forward to March 9th, and JSO contacted her and informed her the car had been found.<\/p>\n
Officers returned several personal items from inside the car but couldn\u2019t return the car itself or her fianc\u00e9\u2019s wheelchair that had been left in it.<\/p>\n
Englin said officers told her they were both being held as evidence in a homicide case.<\/p>\n
\u201cHe said your car was involved in a homicide,\u201d said Anglin.<\/p>\n
Now, 78 days after her car was found, Anglin still doesn\u2019t have the car or her fianc\u00e9\u2019s wheelchair.<\/p>\n
She said she even lost her job because she couldn\u2019t get to and from work.<\/p>\n
Anglin said she\u2019s called JSO at least ten times since March, trying to get answers as to when she might get her car back, but she\u2019s gotten nowhere.<\/p>\n
\u201cI\u2019ll look into that. That\u2019s it. And I never heard anything back, and I called them yesterday. Still didn\u2019t call me back,\u201d said Anglin.<\/p>\n
We reached out to JSO and asked why the release has taken so long.<\/p>\n
\u201cUnfortunately, items in the vehicle that potentially hold evidentiary value must be maintained throughout the investigative and criminal process,\u201d a JSO spokesperson told us in an emailed statement. \u201dWe are working with our partners at the SAO in a resolution to the release of the wheelchair at this time.\u201d<\/p>\n
Criminal defense attorney Chris Carson explained, while unfortunate, JSO and the State Attorney\u2019s Office aren\u2019t doing anything wrong.<\/p>\n
He noted the car and the wheelchair have likely become a critical piece of evidence in the homicide case, and there\u2019s no set timeframe in which it must legally be returned.<\/p>\n
\u201cThey need to kind of balance the individual\u2019s rights to their property with what needs to happen for our community at-large,\u201d said Carson.<\/p>\n
After hearing from Action News Jax, JSO said its Victim Services unit will be reaching out to Anglin to help her fianc\u00e9 get a new wheelchair.<\/p>\n
In response to that news, Anglin said they\u2019ve already had to buy a new wheelchair, and she just wants her car back.<\/p>\n
\u201cWhy don\u2019t you get in my car, drive it to where I live and leave it there and I\u2019ll be happy,\u201d said Anglin.<\/p>\n
Carson said it\u2019s possible Anglin could file a claim with her insurance and get some form of compensation for her vehicle.<\/p>\n
She might also qualify for compensation under the Crime Compensation Trust Fund, but Carson explained payments through that fund aren\u2019t usually doled out until a case concludes with a guilty verdict.<\/p>\n
And there\u2019s no telling how long that might be in this case.<\/p>\n
