MIAMI (WSVN) – The defense has rested in the case against a real estate mogul on trial for a 2022 deadly boat crash.<\/p>\n
On the eighth day of George Pino\u2019s trial, defense attorneys called additional witnesses to make their case that the crash was a tragic accident.<\/p>\n
One of the first witnesses on the stand was a neurologist who described a concussion that Pino suffered in the crash which, his attorneys say, led to difficulties recalling the moments that led up to it.<\/p>\n
Dr. Diana Barratt testified that Pino suffered from amnesia which could have caused him to make false statements after the incident.<\/p>\n
\u201cI know exactly what I saw and then he couldn\u2019t come up with what he saw and then said, \u2018It was really scary,’\u201d she said.<\/p>\n
But prosecutors pushed back against her claims.<\/p>\n
\u201cYou never said to him, \u2018Tell me how this crash happened?’\u201d said prosecutor Laura Adams.<\/p>\n
\u201cNo, I did not,\u201d said Barratt.<\/p>\n
After the doctor\u2019s testimony, a survivor of the boat crash took the stand for a second time.<\/p>\n
Carolina Monterrey watched body camera footage from the Florida Fish and Wildlife Conservation Commission and testified that she saw Pino immediately after the crash.<\/p>\n
\u201cAfter watching that video, did you refresh your recollection that following the accident after the impact, you did in fact see Mr. Pino on the floor unconscious, bleeding?\u201d said the defense attorney.<\/p>\n
\u201cYes,\u201d said Monterrey.<\/p>\n
Throughout the trial, Pino\u2019s defense attorneys have argued that high tide obstructed his view of the channel marker. Multiple witnesses have testified that Pino was not impaired at the time of the crash.<\/p>\n
The 54-year-old Pino is on trial after he crashed his boat into a channel marker in Boca Chita Key, killing 17-year-old Lucy Fernandez.<\/p>\n
On Wednesday, jurors were given the chance to hear from Pino himself, but the defendant turned down the chance to testify.<\/p>\n
\u201cI do not wish to testify,\u201d Pino told the judge.<\/p>\n
Shortly after his decision, his defense team rested its case.<\/p>\n
State prosecutors then took the chance to call on Fernandez\u2019s father, Andy, and Katy Puig\u2019s father, Rudy, to take the stand as rebuttal witnesses.<\/p>\n
Andy described what made him go to the sandbar on that Labor Day weekend with the Pinos.<\/p>\n
\u201cDid you have any plans to go out to the sandbar on Sunday, Sept. 4, 2022?\u201d said Adams.<\/p>\n
\u201cNo,\u201d said Andy.<\/p>\n
\u201cBut you did?\u201d said Adams.<\/p>\n
\u201cBut I did,\u201d said Andy.<\/p>\n
\u201cAnd why did you go?\u201d said Adams.<\/p>\n
\u201cBecause Lucy asked me to go,\u201d said Andy.<\/p>\n
Defense attorneys also got their chance to cross examine Andy.<\/p>\n
\u201cDid you send a text to Mr. Pino that said, \u2018Billy\u2019s on Sunday?’\u201d<\/p>\n
\u201cCorrect,\u201d said Andy.<\/p>\n
Rudy said his daughter\u2019s life changed forever. The crash left Katy with permanent injuries.<\/p>\n
\u201cIs your daughter in the same condition now than she was when she went to Ocean Reef Club?\u201d asked Adams.<\/p>\n
\u201cNo, she\u2019s not,\u201d said Rudy.<\/p>\n
The jury is expected to return on Monday for closing statements.<\/p>\n
