JACKSONVILLE, Fla. \u2013 Customers and employees at a Jacksonville discount store have been dealing with uncomfortable \u2014 and potentially dangerous \u2014 conditions for months. <\/p>\n
The Roses Discount Store on Lem Turner Road on the city\u2019s Northside has been without working air conditioning, and now the property owner is headed to court.<\/p>\n
Resident raises alarm<\/p>\n
Northside resident Dana Maule first raised concerns after noticing the sweltering conditions inside the store.<\/p>\n
\u201cFor weeks, this store has been hot, and nothing has been done about it,\u201d Maule said.<\/p>\n
Maule captured video inside the store, confronting a store employee about the broken AC.<\/p>\n
\u201cIs the air broken or what\u2019s going on?\u201d Maule asked in the video.<\/p>\n
\u201cYes, it\u2019s broken. It\u2019s broken,\u201d the employee responded.<\/p>\n
When News4JAX visited the store, the indoor temperature registered at 81 degrees \u2014 on a day with a high of 92. Fans were staged throughout the store in an attempt to manage the heat.<\/p>\n
What the law says<\/p>\n
News4JAX reached out to the store manager, who declined to comment but provided contact information for the property\u2019s landlord and Rose\u2019s corporate office.<\/p>\n
A call to Rose\u2019s corporate office also yielded little.<\/p>\n
\u201cI unfortunately can\u2019t answer those questions,\u201d a Rose\u2019s representative said over the phone.<\/p>\n
News4JAX spoke with local real estate attorney Zach Roth to find out whether Florida businesses are legally required to provide air conditioning.<\/p>\n
\u201cNo, there\u2019s no statute that requires businesses such as that to have AC,\u201d Roth said. \u201cIf there is AC installed, it has to be maintained in accordance with the building code.\u201d<\/p>\n
City citations, court date set<\/p>\n
City Councilman Reggie Gaffney Jr. of District 8 says his office has been fielding complaints about the store since March.<\/p>\n
\u201cYes, I mean, that\u2019s the property owner who leases the building to Rose\u2019s will be going before the magistrate on July 21 for a hearing,\u201d Gaffney said.<\/p>\n
The city of Jacksonville has issued three citations against the property owner for violating city codes, and the property owner is now set to appear in court on July 21. <\/p>\n
News4JAX reached out multiple times to both the property owner and Rose\u2019s corporate office for comment. The property owner has not responded, and Rose\u2019s corporate office has not answered our questions.<\/p>\n
