{"id":320544,"date":"2026-06-26T12:06:09","date_gmt":"2026-06-26T12:06:09","guid":{"rendered":"https:\/\/www.newsbeep.com\/us-fl\/320544\/"},"modified":"2026-06-26T12:06:09","modified_gmt":"2026-06-26T12:06:09","slug":"florida-begins-push-to-ban-undocumented-students-from-competitive-public-universities","status":"publish","type":"post","link":"https:\/\/www.newsbeep.com\/us-fl\/320544\/","title":{"rendered":"Florida begins push to ban undocumented students from competitive public universities"},"content":{"rendered":"<p>The Board of Governors, which oversees the state&#8217;s public universities, voted on Thursday to move forward with an amendment that would bar undocumented students from the state&#8217;s more competitive universities.<\/p>\n<p>\nThe <a href=\"https:\/\/www.flbog.edu\/wp-content\/uploads\/2026\/06\/Regulation-6.001-1.pdf\" class=\"Link\" target=\"_blank\" rel=\"nofollow noopener\">amendment reads<\/a>, in full: &#8220;Beginning with the 2027-28 academic year, a person who is not lawfully present in the United States shall not be eligible for initial enrollment in any state university which, for the two most recent academic years, did not admit all academically qualified applicants, except for cases in which applicants were rejected for nonacademic reasons.&#8221;<\/p>\n<p>\nThat could include schools such as the <a href=\"https:\/\/www.usf.edu\/admissions\/freshmen\/contact-us\/appeals-process.aspx\" class=\"Link\" target=\"_blank\" rel=\"nofollow noopener\">University of South Florida<\/a>, <a href=\"https:\/\/admissions.ufl.edu\/denied\" class=\"Link\" target=\"_blank\" rel=\"nofollow noopener\">University of Florida<\/a> and others, that outline a selective admissions process.<\/p>\n<p>\nEmily Sikes, the Vice chancellor for Academic and Student Affairs, clarified during Thursday&#8217;s meeting that currently enrolled students would not be affected.<\/p>\n<p>\nSikes added that the university system does not have a specific code attached to current students who may be in the U.S. unlawfully.<\/p>\n<p>ALSO READ: <a href=\"https:\/\/www.wusf.org\/education\/2025-05-12\/florida-dreamers-are-scrambling-as-a-tuition-hike-could-put-college-out-of-reach\" class=\"Link\" target=\"_blank\" rel=\"nofollow noopener\">These Florida &#8216;Dreamers&#8217; say they&#8217;re scrambling as a tuition hike could put college out of reach<\/a><\/p>\n<p>\nWhen BOG member Ashley Bell Barnett asked how the university system defines &#8220;not lawfully present,&#8221; BOG leaders deferred to the federal government.<\/p>\n<p>\n&#8220;Lawful presence is as determined by the federal government, so we have some resources that will be able to work with universities based on their guidance,&#8221; said a member of the general counsel.<\/p>\n<p>\nThe push to restrict admissions for undocumented students at the university level comes just before the Department of Education is <a href=\"https:\/\/www.fldoe.org\/policy\/state-board-of-edu\/meetings\/2026\/2026-06-30\/\" class=\"Link\" target=\"_blank\" rel=\"nofollow noopener\">set to vote on barring<\/a> undocumented students from public colleges and GED programs next week.<\/p>\n<p>\nThe moves would severely restrict access to higher education in Florida.<\/p>\n<p>\nLast year, the state eliminated in-state tuition for undocumented students in public colleges and universities, including for Dreamers protected from deportation under the DACA program.<\/p>\n<p>\nBefore the law change, students, regardless of immigration status, could attend public higher education institutions at the in-state tuition rate, as long as they proved they were residents of Florida.<\/p>\n<p>ALSO READ: <a href=\"https:\/\/www.wusf.org\/politics-issues\/2026-04-27\/immigrant-advocates-slam-florida-education-departments-move-block-undocumented-students\" class=\"Link\" target=\"_blank\" rel=\"nofollow noopener\">Immigrant advocates slam Florida&#8217;s plan to bar undocumented students from colleges<\/a><\/p>\n<p>\nStudents, who had lived in the state their whole lives, suddenly<a href=\"https:\/\/www.wusf.org\/education\/2026-03-02\/tuition-florida-undocumented-college-students-tripled-how-are-they-doing-now\" class=\"Link\" target=\"_blank\" rel=\"nofollow noopener\"> saw their tuitions triple<\/a>, as a result.<\/p>\n<p>\nAbout 8,000 undocumented students graduate from Florida high schools each year, according to the <a href=\"https:\/\/www.higheredimmigrationportal.org\/state\/florida\/\" class=\"Link\" target=\"_blank\" rel=\"nofollow noopener\">Higher Ed Immigration Portal<\/a>.<\/p>\n<p>\nAbout 49,000 undocumented students are enrolled in higher ed institutions in Florida.<\/p>\n<p>\nNorin Dollard from the Florida Policy Institute (FPI) said the public university system and college system could be overstepping by creating the new policies, since there isn&#8217;t a state statute in place.<\/p>\n<p>\nDollard <a href=\"https:\/\/www.leg.state.fl.us\/statutes\/index.cfm?App_mode=Display_Statute&amp;Search_String=1001.02&amp;URL=0100-0199\/0120\/Sections\/0120.536.html\" class=\"Link\" target=\"_blank\" rel=\"nofollow noopener\">cited Florida law<\/a> that says &#8220;an agency may adopt only rules that implement or interpret the specific powers and duties granted by the enabling statute.&#8221;<\/p>\n<p>\nIn the 2026 legislative session, lawmakers had tried to pass <a href=\"https:\/\/www.floridapolicy.org\/posts\/sb-1052-and-hb-1279s-bans-are-harsh-limiting-higher-education-enrollment-and-financial-support-for-immigrants\" class=\"Link\" target=\"_blank\" rel=\"nofollow noopener\">bills that would limit non-residents <\/a>\u2013 including undocumented immigrants and other immigrants without permanent residency \u2013 in public universities.
