(CBS12) \u2014 <a href=\"https:\/\/cbs12.com\/topic\/Governor%20Ron%20DeSantis\" target=\"_blank\" rel=\"nofollow noopener\">Gov. Ron DeSantis<\/a> has vetoed a bill that would have placed new statewide rules on <a href=\"https:\/\/cbs12.com\/topic\/E-Bike\" target=\"_blank\" rel=\"nofollow noopener\">electric bicycles<\/a>, saying the measure could lead to more surveillance and over-policing of riders, even as communities across Florida continue to grapple with crashes and safety concerns involving teens and children on e-bikes and scooters.<\/p>\n<p>The bill, <a href=\"https:\/\/www.flsenate.gov\/Session\/Bill\/2026\/382\" target=\"_blank\" rel=\"nofollow noopener\">CS\/SB 382<\/a>, would have prohibited e-bike riders from traveling faster than 10 miles per hour when within 50 feet of a pedestrian. Riders who violated the rule could have faced a nonmoving traffic violation and fines of more than $100, according to DeSantis\u2019 veto letter.<\/p>\n<p>The legislation,<a href=\"https:\/\/www.flsenate.gov\/Session\/Bill\/2026\/382?Tab=VoteHistory\" target=\"_blank\" rel=\"nofollow noopener\"> which passed both the Florida House and Senate unanimously<\/a>, also would have created a Micromobility Device Safety Task Force to study e-bike regulations and recommend additional changes. Law enforcement agencies would have been required to track e-bike crashes, including the age of the rider, the class of e-bike involved and whether the rider had a learner\u2019s permit or driver\u2019s license.<\/p>\n<p>Supporters pushed the bill as a safety measure at a time when e-bikes and scooters have become more common on sidewalks, streets and school routes. The bill\u2019s stated purpose was to encourage safe e-bike operation and prevent traffic crashes, injuries and fatalities involving the devices.<\/p>\n<p>Recent spate of e-bike incidents<\/p>\n<p>Earlier this month, <a href=\"https:\/\/cbs12.com\/news\/local\/teen-hospitalized-as-trauma-alert-after-crash-involving-e-bike-in-west-palm-beach-west-palm-beach-stacy-road-e-bike-crash-teen-injured-17-year-old-trauma-alert-palm-beach-county-fire-rescue-vehicle-collision-hope-centennial-elementary-school\" target=\"_blank\" rel=\"nofollow noopener\">a 17-year-old boy was hospitalized after a crash involving an e-bike and a vehicle in West Palm Beach<\/a>. The driver involved in that crash told CBS12 News the teen appeared to be going too fast and not paying attention before the collision.<\/p>\n<p>In Port St. Lucie, <a href=\"https:\/\/cbs12.com\/news\/local\/schools-out-summer-reminder-for-drivers-and-kids-to-use-caution-brothers-injured-scooter-crash-port-st-lucie-police-florida-road-safety-e-bikes-lennard-road-village-green-environmental-studies-school\" target=\"_blank\" rel=\"nofollow noopener\">police recently urged caution<\/a> after <a href=\"https:\/\/cbs12.com\/news\/local\/two-teen-boys-airlifted-hospital-lost-control-of-e-bike-strikes-another-child-flown-to-hospital-palm-beach-county-sheriffs-office-florida-news\" target=\"_blank\" rel=\"nofollow noopener\">two brothers, ages 15 and 8, were injured <\/a>when the electric scooter they were riding collided with a vehicle. Police said the case served as a reminder for drivers and children to be alert during the summer months, when more kids are out riding.<\/p>\n<p>In Wellington, <a href=\"https:\/\/cbs12.com\/news\/local\/two-children-airlifted-to-hospital-ebike-pedestrian-crash-intersection-of-greenview-shores-boulevard-meadow-avenue-palm-beach-county-fire-rescue-florida-news\" target=\"_blank\" rel=\"nofollow noopener\">two teen boys were airlifted to the hospital after one boy lost control of an e-bike and struck another child<\/a>, leaving him unconscious, according to the Palm Beach County Sheriff\u2019s Office.<\/p>\n<p>The issue has also been a concern in Jupiter, where <a href=\"https:\/\/cbs12.com\/news\/local\/e-bike-town-hall-jupiter-officials-address-safety-following-tragic-death-of-student\" target=\"_blank\" rel=\"nofollow noopener\">town officials held an e-bike safety town hall after the death of a Jupiter Middle School student<\/a> in an e-bike crash. CBS12 News previously reported that the crash prompted renewed discussion about enforcement, education and safety rules for young riders.<\/p>\n<p>And in April, the <a href=\"https:\/\/cbs12.com\/news\/local\/martin-county-deputies-crack-down-on-illegal-e-bikes-after-resident-complaints-traffic-unit-road-patrol-deputies-community-policing-e-bike-crashes-youth-behavior-public-safety-florida-law-e-bike-regulations-speed-limits-28-mph-750-watt-limit\" target=\"_blank\" rel=\"nofollow noopener\">Martin County Sheriff\u2019s Office says it was moving from warning riders and families about e-bike laws to actively enforcing them<\/a>, citing a growing number of complaints and safety concerns across the county.<\/p>\n<p>DeSantis: Bill goes too far<\/p>\n<p>Despite those concerns, DeSantis said the bill went too far.<\/p>\n<p>In his veto letter, DeSantis wrote that the 10-mile-per-hour limit near pedestrians would be \u201cdifficult for a bicyclist to measure when safely operating an e-bike.\u201d He also warned that the violation would \u201cinevitably be enforced with speed detection and surveillance devices.\u201d<\/p>\n<p>\u201cThis bill will likely lead to enhanced surveillance by local governments against citizens,\u201d DeSantis wrote.<\/p>\n<p>At a news conference Friday, DeSantis expanded on his reasoning, saying he did not want Florida to create a system where e-bike riders are closely monitored by law enforcement.<\/p>\n<p>\u201cMaybe there\u2019s problems,\u201d DeSantis said. \u201cBut what it will lead to is more surveillance of people by law enforcement. And we don\u2019t need that.\u201d<\/p>\n<p>DeSantis also questioned why the bill would create a task force while also immediately imposing new statewide rules.<\/p>\n<p>\u201cThey also set up an e-bike commission,\u201d DeSantis said. \u201cBut it\u2019s like, okay, you\u2019re already substantively legislating. Why are you doing a commission? If you\u2019re going to do a commission, then the commission can come and do that thing.\u201d<\/p>\n<p>The governor said he believed the bill could have unintended consequences.<\/p>\n<p>\u201cDo we really want to have policing of e-bikes?\u201d DeSantis said. \u201cAnd are you going 10 miles or 8 miles or whatever? I think it was a little bit of an overreach.\u201d<\/p>\n<p>The veto leaves Florida\u2019s current e-bike framework in place, while local governments and school districts continue to look for ways to respond to safety concerns. Some communities have already taken action, including restrictions or discussions around e-bikes and scooters on campuses, sidewalks and public paths.<\/p>\n<p>The debate is likely to continue as e-bikes become more popular among students and families, and as police, parents and local leaders try to balance safety concerns with concerns about enforcement and government overreach.<\/p>\n","protected":false},"excerpt":{"rendered":"WEST PALM BEACH, Fla.
