{"id":321165,"date":"2026-06-26T21:49:34","date_gmt":"2026-06-26T21:49:34","guid":{"rendered":"https:\/\/www.newsbeep.com\/us-fl\/321165\/"},"modified":"2026-06-26T21:49:34","modified_gmt":"2026-06-26T21:49:34","slug":"teen-accused-in-overtown-child-gang-rape-case-will-stay-locked-up-ahead-of-trial","status":"publish","type":"post","link":"https:\/\/www.newsbeep.com\/us-fl\/321165\/","title":{"rendered":"Teen accused in Overtown child gang rape case will stay locked up ahead of trial"},"content":{"rendered":"<p class=\"c-paragraph\">MIAMI \u2014 A 15-year-old <a href=\"https:\/\/www.local10.com\/news\/local\/2026\/02\/27\/boys-12-and-13-charged-as-adults-in-overtown-rape-of-12-year-old-girl-police-say\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.local10.com\/news\/local\/2026\/02\/27\/boys-12-and-13-charged-as-adults-in-overtown-rape-of-12-year-old-girl-police-say\/\">accused of helping restrain<\/a> a 12-year-old girl while she was raped at a Miami community garden will remain locked up as he awaits trial, a judge ruled Friday.<\/p>\n<p class=\"c-paragraph\"><a href=\"https:\/\/www.local10.com\/news\/local\/2026\/06\/26\/adolescente-acusado-en-caso-de-violacion-en-grupo-de-menores-en-overtown-permanecera-encarcelado-hasta-el-juicio\/\" target=\"_blank\" rel=\"noreferrer nofollow noopener\" title=\"https:\/\/www.local10.com\/news\/local\/2026\/06\/26\/adolescente-acusado-en-caso-de-violacion-en-grupo-de-menores-en-overtown-permanecera-encarcelado-hasta-el-juicio\/\">Leer en espa\u00f1ol<\/a><\/p>\n<p class=\"c-paragraph\">Xavier Tyson is one of three boys charged in connection with the alleged attack, which police say occurred in June 2025 at The Green Haven Project at 1160 NW Second Ave. in the city\u2019s Overtown neighborhood.<\/p>\n<p class=\"c-paragraph\">According to investigators with the Miami Police Department, 13-year-old Nelson Nunez was accused of raping the victim while Tyson, then 14, and <a href=\"https:\/\/www.local10.com\/news\/local\/2026\/03\/23\/judge-grants-release-for-boy-12-in-overtown-child-rape-case-but-13-year-old-to-stay-jailed\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.local10.com\/news\/local\/2026\/03\/23\/judge-grants-release-for-boy-12-in-overtown-child-rape-case-but-13-year-old-to-stay-jailed\/\">13-year-old Jusiah Jones<\/a> held her down. Officers testified the girl had rocks placed in her mouth to keep her quiet during what police say was a 30-minute assault.<\/p>\n<p class=\"c-paragraph\">\u201cShe was begging for them to stop and then they put rocks in her mouth and said if you keep yelling we\u2019ll put more rocks in your mouth,\u201d MPD Detective Louis Joseph testified on Friday.<\/p>\n<p class=\"c-paragraph\">Police described the rocks as small, beige and pebble-like.<\/p>\n<p class=\"c-paragraph\">Tyson\u2019s attorney called multiple witnesses in an effort to secure his release, including his aunt and legal guardian, who described him as respectful and non-violent. <\/p>\n<p class=\"c-paragraph\">\u201cHe would never do anything like that,\u201d said Amadonne Gabriel, Tyson\u2019s Aunt. \u201cHe\u2019s a respectful child. Loving caring. I have other kids. He plays well. Not violent.\u201d<\/p>\n<p class=\"c-paragraph\">The co-founder of the community garden, Jorge Palacios, also testified, saying Tyson had become a familiar and well-regarded presence at the program.<\/p>\n<p class=\"c-paragraph\">\u201cHe became a known face at the garden \u2014 the main child you would interact with,\u201d Palacios said. \u201cPeople would come looking for him.\u201d<\/p>\n<p class=\"c-paragraph\">Miami-Dade Judge Richard Hersch was unconvinced, citing the severity of Tyson\u2019s alleged role.<\/p>\n<p class=\"c-paragraph\">\u201cYour client held the child down while his friends raped her,\u201d he said. \u201cI\u2019m uncomfortable with the degree of culpability.
