WEST MIAMI, Fla. \u2014 A West Miami man is facing three felony charges after he pulled a gun on, choked and beat another man who was upset at him over a revolting act during a sexual encounter, according to police.<\/p>\n
West Miami police said the crime happened at around 6 a.m. Sunday at the home of suspect Luis Alberto Negrin, 38, in the 6100 block of Southwest 14th Street.<\/p>\n
Police said they responded after getting a call about the victim \u201ccrying and bleeding in the middle of the roadway.\u201d<\/p>\n
An arrest report states that the victim and Negrin had been drinking and smoking cigarettes throughout the early morning hours, which eventually led to sex.<\/p>\n
Police said during the encounter, the victim became upset when Negrin committed an act involving \u201cfecal matter\u201d without the victim\u2019s consent, leaving the victim \u201cangry and disgusted\u201d and leading to a \u201cverbal argument.\u201d<\/p>\n
The report states that it \u201cquickly escalated into a physical confrontation\u201d when Negrin pulled a small silver gun out and pointed it at the victim\u2019s head \u201cwhile making threatening gestures.\u201d<\/p>\n
\u201cFearing for his safety and believing (Negrin) was capable of shooting him, (the victim) stated that he slowly backed away further into the residence in an attempt to de-escalate the situation,\u201d police wrote. \u201c(The victim) advised that (Negrin) continued to follow him while keeping the firearm aimed at his head.\u201d<\/p>\n
Once in the kitchen, police said Negrin \u201cplaced him into a headlock\u201d and \u201capplied extreme pressure around his neck, making it difficult for him to breathe.\u201d<\/p>\n
Police said the victim believed he lost consciousness twice. Authorities said after being released from the headlock the man tried to call 911, but Negrin grabbed his cellphone to keep him from calling the police.<\/p>\n
According to the report, Negrin punched the victim \u201cmultiple times,\u201d causing cuts, redness and swelling to his face. <\/p>\n
\u201c(The victim) stated that he continued looking for an opportunity to escape because he believed (Negrin) would continue to assault him or possibly shoot him,\u201d the report states.<\/p>\n
Police said the victim eventually managed to \u201cbreak free\u201d and run to a neighbor\u2019s home to seek help. Responding officers said the man had injuries consistent with his account of the incident.<\/p>\n
Authorities said when they went to Negrin\u2019s home to speak with him, he barricaded himself inside for two hours before finally opening the door. <\/p>\n
Police took Negrin into custody on charges of aggravated assault with a firearm, battery by strangulation, tampering with a witness or victim and battery.<\/p>\n
As of Monday afternoon, he was being held in the Turner Guilford Knight Correctional Center on an $8,500 bond.<\/p>\n
