Provisions from a law passed last year are set to finally take effect this week. <\/p>\n
According to a report from our sister station in Orlando, WKMG<\/a>, that law \u2014 SB 606<\/a> \u2014 was first signed by Gov. Ron DeSantis back in June 2025, though a few key rules are slated to kick off on Wednesday, July 1.<\/p>\n Under this law, if a restaurant charges an automatic fee called an \u201coperations charge\u201d (this can include things like a service charge, automatic gratuity, delivery fee, or credit card surcharge), it must be clear with customers about it:<\/p>\n Explain the Fee: Menus, contracts, and ordering sites\/apps must explain the fee.\u00a0The notice has to say the\u00a0amount or percentage\u00a0of the operations charge and the\u00a0purpose\u00a0of the charge. It also has to be easy to see (in a font at least as large as menu descriptions or contract fine print).<\/p>\n Visible Notices: If there\u2019s no menu or table service, the notice must be posted clearly\u00a0on a menu board or on a sign near the register where people pay.<\/p>\n Clear Amounts: The bill must include a clear notice\u00a0that an operations charge is being added, and it must show the\u00a0percentage or amount.<\/p>\n Receipt Charges: Receipts must separate the charges\u00a0so customers can easily tell what they paid for. Each receipt must list separate lines for\u00a0gratuity (tip),\u00a0operations charge, and\u00a0sales tax. If the operations charge includes an\u00a0automatic gratuity, that must be shown separately on the receipt.<\/p>\n Business Lawsuits: The law also says this section\u00a0does not create a right for customers to sue\u00a0a business just for not following these notice rules.<\/p>\n Other Situations: It\u00a0doesn\u2019t apply\u00a0to certain pre-disclosed deals like a\u00a0dining plan\u00a0or a\u00a0fixed-price meal\/package\u00a0where the total price is shown before purchase.<\/p>\n Meanwhile, there are over 100 other laws also taking effect on July 1.
