Ron DeSantis, a Republican, signed into law in 2022, had already been blocked that same year by a lower court judge. That judge had said the law amounted to viewpoint discrimination and violated the First Amendment.<\/p>\n<p class=\"css-140ip4z e1me5xab0\">On Tuesday, a U.S. appellate court agreed in 2-to-1 decision, criticizing the state\u2019s assertion that it can control the speech of a professor whose salary it pays.<\/p>\n<p class=\"css-140ip4z e1me5xab0\">The law \u201cruns headlong\u201d into the Supreme Court\u2019s endorsements of academic freedom, wrote the two judges, from the U.S. Court of Appeals for the 11th Circuit.<\/p>\n<p class=\"css-140ip4z e1me5xab0\">\u201cFlorida\u2019s salary-for-speech rule is a breathtaking assertion of power to ban unpopular ideas from public discourse in the very places the State\u2019s own statutes recognize as centers of inquiry \u2014 classrooms where students are trusted to puzzle through ideas that are good and bad, easy and hard, ideally getting ever closer to the truth,\u201d the decision said.<\/p>\n<p class=\"css-140ip4z e1me5xab0\">The act includes a similar provision for K-12 education that restricts how concepts <a class=\"css-yywogo\" href=\"https:\/\/www.nytimes.com\/2023\/07\/21\/us\/desantis-florida-black-history-standards.html\" title=\"\" rel=\"nofollow noopener\" target=\"_blank\">related to sexism and racism can be taught<\/a>. That remains in place.<\/p>\n<p class=\"css-140ip4z e1me5xab0\">The DeSantis administration did not immediately respond to a message seeking comment.<\/p>\n<p class=\"css-140ip4z e1me5xab0\">Several states, including Oklahoma, have also passed laws aimed at curbing the teaching of \u201cdivisive concepts.\u201d The American Civil Liberties Union, which filed the court case in Florida, is also challenging the Oklahoma law, among others.<\/p>\n<p class=\"css-140ip4z e1me5xab0\">\u201cThis ruling sets a strong precedent that higher education cannot be limited to the whims of politicians,\u201d Leah Watson, a senior staff attorney with the A.C.L.U., said in a statement.<\/p>\n<p class=\"css-140ip4z e1me5xab0\">The Florida ruling does not directly affect legal challenges in other states with similar laws, but it signals that the First Amendment \u201cstill protects against blatant ideological censorship of teaching at public universities,\u201d said Jonathan Friedman, with PEN America, a free-expression group.<\/p>\n<p class=\"css-140ip4z e1me5xab0\">Recognizing that laws like Stop WOKE were on shaky constitutional ground, some conservatives in recent years <a class=\"css-yywogo\" href=\"https:\/\/thefederalist.com\/2022\/12\/13\/the-smart-lawmakers-guide-to-writing-anti-critical-race-theory-laws-that-will-stand-up-in-court\/\" title=\"\" rel=\"noopener noreferrer nofollow\" target=\"_blank\">have advocated different approaches<\/a> to asserting control over curriculum they don\u2019t favor.
