According to the affidavit for Wheaton’s arrest warrant, City\/County Investigative Bureau agents with the Seminole Collaborative and Opioid Response Effort were conducting surveillance on a black sedan after a Seminole County deputy “observed the vehicle to have unlawful tint on a prior date and learning the renter of the vehicle was Marquavious Wheaton, who had a criminal history including but not limited to armed trafficking of over 4 grams of fentanyl.” Agents had followed the sedan onto northbound State Road 417 by the time the sheriff’s office’s ALERT Aviation Unit arrived on scene, the affidavit states. The deputy managed to catch up to Wheaton at one point, but attempts to conduct a traffic stop were unsuccessful while Wheaton traveled at speeds over 110 mph at times, according to the affidavit. The sedan reportedly exited at H.E. Thomas Jr. Parkway before merging back into northbound S.R. 417. In the on-ramp, while directly behind the sedan, the deputy turned on their lights and siren, at which point the sedan “sped off” and the ground pursuit was deactivated per policy, the affidavit states. The sedan went on to drive recklessly, exiting S.R. 417 onto Airport Boulevard, driving on the wrong side of the road on multiple occasions, passing vehicles on the shoulder, and running red lights “despite no law enforcement vehicles being near it” besides the helicopter, according to the affidavit. The collision occurred as Wheaton drove southbound on U.S. Highway 17-92 at Sunnytown Road in excess of 100 mph, striking the driver’s side of a car with Christopher Marier and Tyler Marier inside, investigators said. Christopher Marier and Tyler Marier were both pronounced dead at the scene. Christopher Marier was an assistant professor at the University of Central Florida’s Department of Criminal Justice, his family confirmed to WESH 2 News. After the crash, Wheaton was taken into custody and transported to Orlando Regional Medical Center. The arrest warrant for Wheaton how this all started. The document said agents with the Seminole Collaborative and Opioid Response Effort initially tried to pull Wheaton over in a traffic stop. It said Wheaton “sped off at a high rate of speed.” Agents then “deactivated the emergency equipment and disengaged from the stop,” citing the Seminole County Sheriff’s Office Pursuit Policy. WESH 2 News obtained a copy of that policy on Thursday. “A decision to terminate a pursuit may be the most rational means of protecting property and the lives of the public, law enforcement officers, and suspects,” it states. “Deputies have an obligation to discontinue a pursuit when circumstances dictate it is no longer justified or reasonable.” In previous WESH 2 News reporting, Casselberry police said there was no ground pursuit because of public safety concerns. The suspect was followed by air for about 17 minutes, according to aerial footage released by the sheriff’s office. A spokesperson with SCSO said officials were trying to end Wheaton’s speeding safely. “As the suspect vehicle fled, responding units were working to get into position in the event an opportunity to safely deploy stop sticks presented itself,” an emailed statement said. “However, the crash occurred before that opportunity presented itself.” Thomas Gleason, who is on the advisory board for PursuitSAFETY, has analyzed hundreds of pursuits and high-speed chases. “I reviewed Seminole County’s policy,” he said. “What they did with this, it appears to be within policy at first viewpoints.” Wheaton is due back in court at 2 p.m. Friday for his initial appearance.
