(CBS12)  \u2014 Florida<a href=\"https:\/\/www.myfloridalegal.com\/ag-bio\" target=\"_blank\" rel=\"nofollow noopener\"> Attorney General James Uthmeier<\/a> is asking a federal judge to send the state&#8217;s lawsuit against OpenAI and CEO Sam Altman back to state court, arguing the case is based on Florida law and was improperly removed to federal court.<\/p>\n<p>The motion was filed Friday in the <a href=\"https:\/\/www.flsd.uscourts.gov\/\" target=\"_blank\" rel=\"nofollow noopener\">U.S. District Court for the Southern District of Florida&#8217;s<\/a> Fort Pierce Division. U.S. District <a href=\"https:\/\/cbs12.com\/topic\/Judge%20Aileen%20Cannon\" target=\"_blank\" rel=\"nofollow noopener\">Judge Aileen Cannon<\/a> has not yet ruled on the request.<\/p>\n<p>The state argues the lawsuit is based solely on Florida law, not federal law, and says OpenAI wrongly moved the case to federal court by arguing it involves the federal Children&#8217;s Online Privacy Protection Act, or COPPA. Florida says its complaint does not bring a claim under COPPA but instead cites alleged violations of the federal law as one basis for claims under Florida&#8217;s consumer protection law.<\/p>\n<p>See also: <a href=\"https:\/\/cbs12.com\/news\/local\/not-a-reflection-of-okeechobee-county-leaders-respond-after-controversial-race-comments-okeechobee-county-okeechobee-officials-okeechobee-board-of-county-commissioners-okeechobee-meeting-public-comment-controversial-comments-race-comments-\" target=\"_blank\" rel=\"nofollow noopener\">Okeechobee officials push back after speaker calls for preserving &#8216;white culture&#8217;<\/a><\/p>\n<p>In June, Uthmeier <a href=\"https:\/\/cbs12.com\/news\/local\/floridas-attorney-general-james-uthmeier-speak-west-palm-beach-florida-news-office-of-the-attorney-general-flagler-drive-office-news-conference\" target=\"_blank\" rel=\"nofollow noopener\">announced in West Palm Beach<\/a> that Florida was suing OpenAI and Altman. He accused the company of putting children at risk by marketing ChatGPT as safe while allegedly failing to address the serious dangers associated with artificial intelligence.<\/p>\n<p>The lawsuit, filed in Highlands County Circuit Court, is what Uthmeier called the nation&#8217;s first state-led legal challenge against OpenAI. Florida alleges the company violated the Florida Deceptive and Unfair Trade Practices Act by prioritizing growth and profits over user safety.<\/p>\n<p>On July 2, OpenAI filed a notice of removal, asking to move the lawsuit from Highlands County Circuit Court to the U.S. District Court for the Southern District of Florida. The company argued the case belongs in federal court because it involves alleged violations of the Children&#8217;s Online Privacy Protection Act, or COPPA.<\/p>\n","protected":false},"excerpt":{"rendered":"FORT PIERCE, Fla.
