Cory Mills<\/a> off the ballot, ruling that the challenge to the Republican\u00a0congressman&#8217;s\u00a0qualification paperwork does not provide a legal basis for the court to intervene in the election.\u00a0<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">In an oral ruling from the bench, Marsh said the case\u00a0ultimately turns\u00a0on the limits of judicial\u00a0authority\u00a0and the role Florida law assigns to election officials. In this case, Alejandro Blair, a Florida notary public and the chief of staff to Florida Congressman Greg Steube.<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">Johnson is contending Mills and Blair were in Washington on June 4, the date of the notarization, and that Blair is not a legal notary public in the District of Columbia.<\/p>\n<p><img alt=\"Circuit Judge Lee Marsh is running for re-election to his spot on the 2nd Judicial Circuit bench.\" loading=\"lazy\" width=\"960\" height=\"1379\" decoding=\"async\" data-nimg=\"1\" class=\"rounded-lg\" style=\"color:transparent\" src=\"https:\/\/www.newsbeep.com\/us-fl\/wp-content\/uploads\/2026\/07\/https:\/\/media.zenfs.com\/en\/daytona-beach-news-journal\/cb06ec5901a3b1fb732bad61fc56b06e.jpeg\"\/><\/p>\n<p>Circuit Judge Lee Marsh is running for re-election to his spot on the 2nd Judicial Circuit bench.<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">Marsh said the controlling issue is the language adopted by the Florida Legislature.\u00a0He concluded the\u00a0law, Section\u00a099.021 of Florida Statutes, and precedent\u00a0requires candidates to file paperwork certifying they meet constitutional and statutory qualifications for office.\u00a0<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">The statute assigns\u00a0the Secretary of State\u00a0to review and certify\u00a0qualification documents.\u00a0<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">Marsh specifically declined to expand the statute to authorize courts to look behind qualification paperwork and\u00a0determine\u00a0whether an alleged defect in a notarial act disqualifies a candidate from office. The Legislature, he said, assigned election officials the responsibility for accepting qualification documents, and the court could not create\u00a0additional\u00a0requirements that do not appear in the statutory language.<\/p>\n<p>Who is challenging Cory Mills in the Republican primary?<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">Rollins, who represented Johnson in the hearing, works for the law firm headed by former state legislator Anthony Sabatini, who lost to Mills in the 2022 GOP congressional primary.<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">Marsh dismissed the complaints with\u00a0prejudice;\u00a0finding any\u00a0further proceedings\u00a0would be futile, signaling that the plaintiffs had no\u00a0viable\u00a0legal path to refile the case in circuit court.<\/p>\n<p><img alt=\"U.S. Rep.
