The HOA argues she no longer meets the community\u2019s age restrictions, while Michel says she is honoring her father\u2019s final wish.<\/p>\n<p>\u201cWe fought to the very end, and the fight is not finished just because my dad is gone,\u201d Michel said. \u201cI still have the fight left in me.\u201d<\/p>\n<p>The dispute has become a flashpoint for residents after the HOA proposed <a href=\"https:\/\/www.news4jax.com\/news\/local\/2026\/07\/14\/influencer-fights-hoa-lawsuit-over-inherited-home-in-jacksonville-55-plus-community-as-neighbors-face-155k-assessment\/\" rel=\"nofollow noopener\" target=\"_blank\">a $155,000 special assessment<\/a> that would require about 155 homeowners to contribute about $1,000 each to help cover legal fees associated with the lawsuit.<\/p>\n<p>According to the community\u2019s governing documents, every occupied home must include at least one resident who is 55 or older. The declaration also prohibits anyone under 19 from living in the community and allows the HOA board to grant hardship exceptions at its discretion if the community remains compliant with federal fair housing requirements.<\/p>\n<p>Homeowners are  required to notify the association of changes in occupancy after events such as a death or inheritance.<\/p>\n<p>Resident Patty Acres said the issue isn\u2019t personal.<\/p>\n<p>\u201cIt\u2019s really not about this young lady,\u201d Acres said. \u201cIt\u2019s about enforcing the age requirements across the board.\u201d<\/p>\n<p>Acres, who is under 55 herself, is permitted to live in the community because she resides with her mother, who meets the age requirement.<\/p>\n<p>She said she understands that if her mother were to die, she would no longer be eligible to live there.<\/p>\n<p>\u201cIf something was to happen to my mom and she was to pass away, I would fully be under the understanding that I would not live here,\u201d Acres said.<\/p>\n<p>Acres acknowledged homeowners aren\u2019t happy about the proposed assessment but said enforcing the rules is important.<\/p>\n<p>\u201cNo one\u2019s excited about the $1,000,\u201d she said.<\/p>\n<p>She believes making an exception for Michel could undermine the HOA\u2019s ability to enforce other community rules.<\/p>\n<p>\u201cThe rules are the rules,\u201d Acres said. \u201cIf we don\u2019t enforce the rules for one, we can\u2019t enforce rules for all.\u201d<\/p>\n<p>A community divided<\/p>\n<p>The case has sparked widespread attention online, with Michel\u2019s story spreading across social media and prompting discussion well beyond Northeast Florida.<\/p>\n<p>Michel said the national attention has been overwhelming, but she hopes it leads to broader conversations about families who inherit homes in age-restricted communities.<\/p>\n<p>\u201cI am not equipped to deal with this,\u201d she said. \u201cBut being that I\u2019ve been put in a position to potentially become an advocate for caregivers \u2026 maybe even change the laws \u2026 it\u2019s bittersweet, but it\u2019s for a good reason.\u201d<\/p>\n<p>She said she hopes the case brings clarity for homeowners and caregivers navigating similar situations.<\/p>\n<p>Acres agrees the lawsuit has had an effect on the neighborhood.<\/p>\n<p><img data-dominant-color=\"463331\" data-has-transparency=\"false\" style=\"--dominant-color: #463331;\" fetchpriority=\"high\" decoding=\"async\" width=\"900\" height=\"506\" src=\"https:\/\/www.newsbeep.com\/us-fl\/wp-content\/uploads\/2026\/07\/Bethany-Michel.webp\" alt=\"\" class=\"wp-image-117080 not-transparent\"  \/>Bethany Michel and her late father. | News4Jax<\/p>\n<p>\u201cThis is a situation where the neighborhood is absolutely divided,\u201d she said. \u201cAnd it\u2019s not fun.\u201d<\/p>\n<p>Although she sympathizes with Michel\u2019s circumstances, Acres said she believes the community\u2019s governing documents should be enforced.<\/p>\n<p>\u201cPersonally, I think she should move. I think her dad did her the great honor of leaving the house to her,\u201d Acres said. \u201cBut this is an over-55 community where they\u2019ve chosen to be over 55.
