{"id":357509,"date":"2026-07-30T12:44:10","date_gmt":"2026-07-30T12:44:10","guid":{"rendered":"https:\/\/www.newsbeep.com\/us-fl\/357509\/"},"modified":"2026-07-30T12:44:10","modified_gmt":"2026-07-30T12:44:10","slug":"floridas-proposed-property-tax-amendment-will-require-trade-offs-and-some-residents-could-end-up-with-higher-costs","status":"publish","type":"post","link":"https:\/\/www.newsbeep.com\/us-fl\/357509\/","title":{"rendered":"Florida\u2019s proposed property tax amendment will require trade-offs \u2013 and some residents could end up with higher costs"},"content":{"rendered":"<p>Between <a href=\"https:\/\/www.wlrn.org\/business\/2026-01-13\/south-florida-inflation-prices-groceries-bills\" rel=\"nofollow noopener\" target=\"_blank\">inflation<\/a>, <a href=\"https:\/\/www.sofi.com\/learn\/content\/average-cost-of-car-insurance-in-florida\/\" rel=\"nofollow noopener\" target=\"_blank\">rising car<\/a> and <a href=\"https:\/\/www.insurancebusinessmag.com\/us\/news\/property\/floridians-pay-181-more-for-home-insurance-than-us-average--report-571385.aspx\" rel=\"nofollow noopener\" target=\"_blank\">property insurance premiums<\/a> and the <a href=\"https:\/\/bestroofing.net\/blog\/how-often-do-roofs-need-to-be-replaced\" rel=\"nofollow noopener\" target=\"_blank\">costs of contending<\/a> <a href=\"https:\/\/www.wtxl.com\/northeast-tallahassee\/inflation-is-raising-the-price-of-hurricane-supplies-but-experts-say-the-small-items-matter-most\" rel=\"nofollow noopener\" target=\"_blank\">with extreme<\/a> <a href=\"https:\/\/floridasteelhomes.com\/hurricane-proof-house-cost-in-florida\/\" rel=\"nofollow noopener\" target=\"_blank\">weather<\/a>, many Florida homeowners are feeling financially squeezed.<\/p>\n<p>While the ballot box can\u2019t change the risk of floods or hurricanes, a <a href=\"https:\/\/ballotpedia.org\/Florida_Amendment_3,_Homestead_Tax_Exemptions,_Property_Assessments,_and_Spending_Restrictions_Amendment_(2026)\" rel=\"nofollow noopener\" target=\"_blank\">constitutional amendment on the November ballot<\/a> could reduce homeowners\u2019 costs in the form of lower property taxes. <a href=\"https:\/\/dos.fl.gov\/elections\/laws-rules\/constitutional-amendmentsinitiatives\/\" rel=\"nofollow noopener\" target=\"_blank\">Sixty percent of voters<\/a> must approve the amendment in order for it to become part of the Florida Constitution.<\/p>\n<p>The <a href=\"https:\/\/www.zillow.com\/home-values\/14\/fl\/\" rel=\"nofollow noopener\" target=\"_blank\">average home<\/a> in the state is worth about US$378,000 as of July 2026, with the <a href=\"https:\/\/www.realtor.com\/local\/market\/florida\" rel=\"nofollow noopener\" target=\"_blank\">median sale price<\/a> slightly higher, at around $395,000. This corresponds with property taxes of <a href=\"https:\/\/smartasset.com\/taxes\/florida-property-tax-calculator#O4NOGqPK5X\" rel=\"nofollow noopener\" target=\"_blank\">just over $3,000<\/a> annually. Floridians in <a href=\"https:\/\/smartasset.com\/taxes\/florida-property-tax-calculator\" rel=\"nofollow noopener\" target=\"_blank\">more expensive houses<\/a> may pay double \u2013 or more \u2013 than the taxes on a median-priced home.<\/p>\n<p>As <a href=\"https:\/\/scholar.google.com\/citations?user=IuNVdd8AAAAJ&amp;hl=en&amp;oi=ao\" rel=\"nofollow noopener\" target=\"_blank\">an economist<\/a> living in Florida, I\u2019ve spent the past decade teaching about the economics of government and public finance, <a href=\"https:\/\/www.tampabay.com\/viewpoints\/2026\/01\/22\/10-credit-card-cap-would-make-affordability-crisis-worse-column\/\" rel=\"nofollow noopener\" target=\"_blank\">analyzing<\/a> and breaking down policy, <a href=\"https:\/\/www.tampabay.com\/viewpoints\/2025\/11\/20\/without-competition-expect-tecos-rates-go-up-column\/\" rel=\"nofollow noopener\" target=\"_blank\">policy proposals<\/a> and their <a href=\"https:\/\/www.sun-sentinel.com\/2025\/10\/07\/floridas-homelessness-ban-is-a-taxpayer-shell-game-opinion\/?share=0nssufe5pis0wooeehni\" rel=\"nofollow noopener\" target=\"_blank\">impacts<\/a> on the Sunshine State.<\/p>\n<p>It can be difficult to navigate all the conflicting information and argumentation surrounding this proposed amendment, so I wanted to dig into what it would mean for Florida residents.<\/p>\n<p>What the proposed amendment would change<\/p>\n<p>Current Florida homeowners can apply for a <a href=\"https:\/\/www.investopedia.com\/terms\/h\/homestead-exemption.asp\" rel=\"nofollow noopener\" target=\"_blank\">homestead exemption<\/a> on their primary residence. This exemption allows homeowners to <a href=\"https:\/\/floridarevenue.com\/property\/Documents\/pt113.pdf\" rel=\"nofollow noopener\" target=\"_blank\">deduct up to $50,000<\/a> of their home\u2019s assessed value, which reduces their annual property taxes.<\/p>\n<p>The proposed Amendment 3, officially known as the <a href=\"https:\/\/ballotpedia.org\/Florida_Amendment_3,_Homestead_Tax_Exemptions,_Property_Assessments,_and_Spending_Restrictions_Amendment_(2026)\" rel=\"nofollow noopener\" target=\"_blank\">Homestead Tax Exemptions, Property Assessments, and Spending Restrictions Amendment<\/a>, does not eliminate all property taxes, but it does substantially reduce them. It would increase the current homeowner\u2019s <a href=\"https:\/\/ocpaweb.ocpafl.org\/faqcontent\/HX_FAQ\" rel=\"nofollow noopener\" target=\"_blank\">homestead tax exemption<\/a> to $150,000 in 2027 and to $250,000 in 2028.<\/p>\n<p>New Florida homeowners would qualify for a smaller exemption on their primary residence, which would increase after five years of residency.<\/p>\n<p>Amendment 3 does not provide special tax relief for renters. Landlords could still see <a href=\"https:\/\/www.flhouse.gov\/Sections\/Documents\/loaddoc.aspx?BillNumber=1&amp;DocumentType=Analysis&amp;FileName=h0001z.SAC.DOCX&amp;Session=2026F\" rel=\"nofollow noopener\" target=\"_blank\">meaningful tax increases<\/a> on an annual basis as their properties increase in value.<\/p>\n<p>The <a href=\"https:\/\/www.flsenate.gov\/Session\/Bill\/2026F\/2F\/BillText\/c1\/PDF\" rel=\"nofollow noopener\" target=\"_blank\">ballot initiative\u2019s language<\/a> theoretically limits how tax dollars should be used by county and municipal governments, with the idea that such provisions ensure continued funding for essential services. Indeed, the ballot language provides a list of acceptable expenditures, such as public safety, infrastructure or obligations for employee retirement benefits. <\/p>\n<p>However, the proposed amendment also says funds may be used for \u201c<a href=\"https:\/\/www.flhouse.gov\/Sections\/Documents\/loaddoc.aspx?BillNumber=1&amp;DocumentType=Analysis&amp;FileName=h0001z.SAC.DOCX&amp;Session=2026F\" rel=\"nofollow noopener\" target=\"_blank\">expenditures approved<\/a>\u201d by local and county governments. This broad language on local spending authority may render the earlier stipulations toothless. The overall implication, therefore, is unclear. <\/p>\n<p>If passed, Amendment 3 would lower the cap on annual property assessments on rental and commercial properties from <a href=\"https:\/\/ocpaimages.ocpafl.org\/api\/Content\/GetContentDynamicFile?contentFileID=149816\" rel=\"nofollow noopener\" target=\"_blank\">a 10% increase<\/a> to <a href=\"https:\/\/www.flsenate.gov\/Session\/Bill\/2026F\/2F\/BillText\/c1\/PDF\" rel=\"nofollow noopener\" target=\"_blank\">a 5% increase<\/a>. Since property taxes are based on an asset\u2019s assessed value, this effectively limits tax rate increases for businesses. The same caps would apply to second homes, which do not qualify for a homestead exemption.<\/p>\n<p>A win for taxpayers?<\/p>\n<p>The <a href=\"https:\/\/edr.state.fl.us\/Content\/about\/index.cfm\" rel=\"nofollow noopener\" target=\"_blank\">Florida Revenue Estimating Conference<\/a>, which is the Florida Legislature\u2019s research arm, estimates the bill would reduce revenue from property taxes by <a href=\"https:\/\/edr.state.fl.us\/Content\/conferences\/revenueimpact\/archives\/2026F\/_pdf\/impact0612.pdf\" rel=\"nofollow noopener\" target=\"_blank\">$11.8 billion<\/a> per year.<\/p>\n<p>The bill\u2019s legislative proponents argue the measure is a win for taxpayers, citing <a href=\"https:\/\/www.flsenate.gov\/PublishedContent\/Offices\/President\/6_2_26_Senate_Passes_Historic_Property_Tax_Cut_for_Florida_Homeowners.pdf\" rel=\"nofollow noopener\" target=\"_blank\">reductions in the cost<\/a> of homeownership while <a href=\"https:\/\/www.flsenate.gov\/PublishedContent\/Offices\/President\/6_2_26_Senate_Passes_Historic_Property_Tax_Cut_for_Florida_Homeowners.pdf?utm\" rel=\"nofollow noopener\" target=\"_blank\">maintaining funding for schools<\/a> and other essential services.<\/p>\n<p><a href=\"https:\/\/www.flhouse.gov\/Sections\/Bills\/floorvote.aspx?BillId=84452&amp;VoteId=25213\" rel=\"nofollow noopener\" target=\"_blank\">Detractors in the Legislature<\/a>, meanwhile, cite projected <a href=\"https:\/\/www.cfpublic.org\/politics\/2026-07-16\/orange-county-budget-workshops-highlight-likely-losses-amendment-3\" rel=\"nofollow noopener\" target=\"_blank\">budget shortfalls<\/a>, concerns over the loss of critical services and the bill\u2019s failure to address the primary drivers of increased living costs as their basis for opposition.<\/p>\n<p>            <a role=\"button\" aria-label=\"Zoomable image\" aria-haspopup=\"dialog\" href=\"https:\/\/images.theconversation.com\/files\/749325\/original\/file-20260721-57-ujiss.jpg?ixlib=rb-4.1.1&amp;q=45&amp;auto=format&amp;w=1000&amp;fit=clip\"><img decoding=\"async\" alt=\"Fire trucks and an ambulance on their way to an emergency\" src=\"https:\/\/www.newsbeep.com\/us-fl\/wp-content\/uploads\/2026\/07\/file-20260721-57-ujiss.jpg\" class=\"native-lazy\" loading=\"lazy\"  \/><\/a><\/p>\n<p>              Emergency services are the largest line item in most local governments\u2019 budgets.<br \/>\n              <a class=\"source\" href=\"https:\/\/www.gettyimages.com\/detail\/news-photo\/firefighters-arrive-near-the-offices-of-democratic-news-photo\/1052943436?adppopup=true\" rel=\"nofollow noopener\" target=\"_blank\">Michelle Eve Sandberg\/AFP via Getty Images<\/a><\/p>\n<p>Taxpayers may not end up paying much less<\/p>\n<p>Current homeowners would see their property taxes fall. Others, however, would almost certainly pay more. Florida businesses, landlords and owners of other non-homestead properties would almost certainly see their taxes increase. Research shows that <a href=\"https:\/\/edr.state.fl.us\/content\/presentations\/property-tax-study\/EDR-Presentation-on-Interim-Findings.pdf\" rel=\"nofollow noopener\" target=\"_blank\">when governments<\/a> <a href=\"https:\/\/taxfoundation.org\/research\/all\/state\/property-tax-repeal-replace-revenue\/\" rel=\"nofollow noopener\" target=\"_blank\">cut property taxes<\/a> for some groups, <a href=\"https:\/\/www.lincolninst.edu\/publications\/books\/erosion-property-tax-base\/\" rel=\"nofollow noopener\" target=\"_blank\">taxes shift<\/a> to other groups. <\/p>\n<p>If the state or local governments want to maintain the same revenue, Amendment 3 would necessitate tax increases in other areas, or <a href=\"https:\/\/edr.state.fl.us\/Content\/revenues\/reports\/fiscal-analysis-in-brief\/FiscalAnalysisinBrief2025.pdf\" rel=\"nofollow noopener\" target=\"_blank\">more federal dollars<\/a> to make up for the shortfall. This could include increases in state and local sales tax, expanding the list of goods <a href=\"https:\/\/floridarevenue.com\/forms_library\/current\/dr46nt.pdf\" rel=\"nofollow noopener\" target=\"_blank\">subject to sales taxes<\/a>, or increasing \u201c<a href=\"https:\/\/floridarevenue.com\/Forms_library\/current\/gt800014.pdf\" rel=\"nofollow noopener\" target=\"_blank\">documentary stamp taxes<\/a>,\u201d required on documents such as deeds, bonds and mortgages.<\/p>\n<p>Local consequences<\/p>\n<p>Florida property taxes are levied and collected by some 640 local government entities. There is <a href=\"https:\/\/floridarevenue.com\/property\/Documents\/ptoinfographic.pdf\" rel=\"nofollow noopener\" target=\"_blank\">no state income tax<\/a>. This means that any reductions in property tax revenue directly affect local and county governments.<\/p>\n<p>Local governments could replace declines in tax revenue in several ways. First, they may increase the tax or \u201c<a href=\"https:\/\/floridarevenue.com\/property\/documents\/homeowner_guide_millage.pdf\" rel=\"nofollow noopener\" target=\"_blank\">millage\u201d rate<\/a> on less-protected property categories. These include non-homestead properties and large rental properties.<\/p>\n<p>While Amendment 3 lowers the cap on property assessments for these other property categories, it does not mean taxes on these assets cannot or will not increase. And even small increases in the tax rate can be significant. A 1% increase in taxes on a $15 million commercial property, for example, equates to an increase of $150,000 on the owner\u2019s tax bill. Though Florida\u2019s Senate president, Republican Ben Albritton, stated that the bill would <a href=\"https:\/\/flvoicenews.com\/senate-president-albritton-fast-tracks-special-session-for-desantis-property-tax-plan\/\" rel=\"nofollow noopener\" target=\"_blank\">protect small businesses from tax increases<\/a>, the ballot language does not support this claim. A small tax increase is still a tax increase.<\/p>\n<p>Second, local governments may impose <a href=\"https:\/\/www.leg.state.fl.us\/Statutes\/index.cfm?App_mode=Display_Statute&amp;URL=0100-0199\/0170\/0170.html\" rel=\"nofollow noopener\" target=\"_blank\">special assessments<\/a> or implement higher fees for <a href=\"https:\/\/www.flhouse.gov\/Sections\/Bills\/floorvote.aspx?BillId=84452&amp;VoteId=25213\" rel=\"nofollow noopener\" target=\"_blank\">specific services<\/a>, such as <a href=\"https:\/\/floridadep.gov\/sites\/default\/files\/2023%20Florida%20Solid%20Waste%20Disposal%20Fees.pdf\" rel=\"nofollow noopener\" target=\"_blank\">solid waste<\/a> and <a href=\"https:\/\/fsa.memberclicks.net\/stormwater-utility-rates-in-florida\" rel=\"nofollow noopener\" target=\"_blank\">stormwater utilities<\/a>. They may also choose to levy additional taxes on <a href=\"https:\/\/hcfl.gov\/businesses\/permits-and-records\/permit-fees\" rel=\"nofollow noopener\" target=\"_blank\">permits and inspection fees<\/a>, fuel taxes, or <a href=\"https:\/\/impactfees.org\/florida-impact-fees\" rel=\"nofollow noopener\" target=\"_blank\">other<\/a> <a href=\"https:\/\/floridalicenseplate.org\/vehicle-registration-fees\" rel=\"nofollow noopener\" target=\"_blank\">service charges<\/a> such as vehicle registration fees. State law even allows for possible increases in <a href=\"https:\/\/floridarevenue.com\/taxes\/taxesfees\/Pages\/sales_tax.aspx\" rel=\"nofollow noopener\" target=\"_blank\">local sales taxes<\/a>, though there are meaningful constraints.<\/p>\n<p>Local governments may also increase taxes <a href=\"https:\/\/floridarevenue.com\/taxes\/taxesfees\/Pages\/local_option.aspx\" rel=\"nofollow noopener\" target=\"_blank\">related to tourism<\/a>, such as on food, beverages and hotels. It\u2019s worth noting, however, that this is not a viable avenue for counties with limited tourism, and such revenues would fluctuate depending on tourism trends.<\/p>\n<p>Finally, the state government could transfer additional funds to local governments from <a href=\"https:\/\/www.flgov.com\/eog\/news\/press\/2026\/governor-ron-desantis-signs-florida-fiscal-year-2026-2027-budget-capping-eight\" rel=\"nofollow noopener\" target=\"_blank\">other state revenue sources<\/a>. Such <a href=\"https:\/\/www.leg.state.fl.us\/Statutes\/index.cfm?App_mode=Display_Statute&amp;Search_String=&amp;URL=0200-0299\/0218\/Sections\/0218.23.html\" rel=\"nofollow noopener\" target=\"_blank\">mechanisms already exist<\/a>, though Amendment 3 does not make specific provisions for increased state-provided funding.<\/p>\n<p>            <a role=\"button\" aria-label=\"Zoomable image\" aria-haspopup=\"dialog\" href=\"https:\/\/images.theconversation.com\/files\/749650\/original\/file-20260722-69-28nd5.jpg?ixlib=rb-4.1.1&amp;q=45&amp;auto=format&amp;w=1000&amp;fit=clip\"><img decoding=\"async\" alt=\"kids playing basketball at a park\" src=\"https:\/\/www.newsbeep.com\/us-fl\/wp-content\/uploads\/2026\/07\/file-20260722-69-28nd5.jpg\" class=\"native-lazy\" loading=\"lazy\"  \/><\/a><\/p>\n<p>              Many public parks are cared for by local governments and funded by property taxes.<br \/>\n              <a class=\"source\" href=\"https:\/\/www.gettyimages.com\/detail\/photo\/latina-mother-with-teenage-children-playing-royalty-free-image\/1128084571?phrase=kids%20playing%20at%20florida%20public%20playground&amp;searchscope=image%2Cfilm&amp;adppopup=true\" rel=\"nofollow noopener\" target=\"_blank\">Drazen_\/E+ via Getty Images<\/a><\/p>\n<p>Schools and essential services<\/p>\n<p>School-related property taxes are <a href=\"https:\/\/ballotpedia.org\/Florida_Amendment_3,_Homestead_Tax_Exemptions,_Property_Assessments,_and_Spending_Restrictions_Amendment_(2026)\" rel=\"nofollow noopener\" target=\"_blank\">explicitly exempt<\/a> from Amendment 3\u2019s tax cuts.<\/p>\n<p>And according to Albritton, the amendment would also <a href=\"https:\/\/www.flsenate.gov\/PublishedContent\/Offices\/President\/6_2_26_Senate_Passes_Historic_Property_Tax_Cut_for_Florida_Homeowners.pdf\" rel=\"nofollow noopener\" target=\"_blank\">ensure funding for critical services<\/a>, such as infrastructure and public safety. <\/p>\n<p>However, essential services would almost certainly be affected. For most Florida counties, these services make up the <a href=\"https:\/\/flicg.org\/wp-content\/uploads\/2021\/03\/revenue-and-expenditure-booklet-2021_WEB-Version.pdf\" rel=\"nofollow noopener\" target=\"_blank\">largest line item<\/a> in their annual expenditures. Reducing <a href=\"https:\/\/edr.state.fl.us\/Content\/local-government\/data\/revenues-expenditures\/stwidefiscal.cfm\" rel=\"nofollow noopener\" target=\"_blank\">property taxes<\/a> has direct implications for essential service budgets.<\/p>\n<p>Impacts on services would be uneven across the state. While some funding for police, fire and emergency medical services comes from state and federal sources, these services are <a href=\"https:\/\/edr.state.fl.us\/Content\/local-government\/data\/revenues-expenditures\/stwidefiscal.cfm\" rel=\"nofollow noopener\" target=\"_blank\">primarily the responsibility<\/a> of local governments. Local property taxes also fund services and facilities such as libraries and public parks.<\/p>\n<p>Smaller, less-populated counties would be <a href=\"https:\/\/itep.org\/effects-of-property-tax-limits\/\" rel=\"nofollow noopener\" target=\"_blank\">disproportionately vulnerable to service cuts<\/a> compared with their larger counterparts. They lack a large tax base and are less able to generate revenue from other sources.<\/p>\n<p>Providers of essential services have raised these concerns. In a rare position paper, the Florida Fire Chiefs\u2019 Association has <a href=\"https:\/\/www.youtube.com\/watch?v=FW2bxXuJDIs\" rel=\"nofollow noopener\" target=\"_blank\">directly opposed Amendment 3<\/a>, saying it would \u201ccreate substantial uncertainty\u201d around emergency services funding throughout the state.<\/p>\n<p>Other considerations<\/p>\n<p>This legislation hinges on several assumptions. <\/p>\n<p>Amendment 3 assumes the caps on non-homestead properties will prevent overly burdensome tax increases on those properties. It also assumes that public safety and other key services can be protected through top-down rules on local spending. Implementing this legislation will also require the necessary personnel and infrastructure to effectively administer the law. If any of these assumptions is incorrect, the implications for businesses, local governments and Floridians are significant.<\/p>\n<p>There are also some <a href=\"https:\/\/floridaphoenix.com\/2026\/07\/07\/another-amendment-3-challenge-filed-by-bipartisan-pair-of-former-legislators\/\" rel=\"nofollow noopener\" target=\"_blank\">questions about the legality<\/a> of classifying current and future Florida homeowners differently. This is particularly relevant when considering questions of <a href=\"https:\/\/edr.state.fl.us\/Content\/conferences\/revenueimpact\/archives\/2026F\/_pdf\/impact0612.pdf\" rel=\"nofollow noopener\" target=\"_blank\">residency and duration of residency<\/a>.<\/p>\n<p>In the past, Florida policymakers have drawn new residents and businesses to the state with the promise of no income taxes, a low cost of living and lower overall taxes compared to other states. <\/p>\n<p>Amendment 3, while aligned with this \u201clow tax\u201d ideal, reveals real tensions when it comes to tax policy. The state can reduce property taxes, but those reductions would require trade-offs, such as raising other taxes or reducing government services to Floridians. The question is not whether these trade-offs exist, but whether they are acceptable in exchange for lower property taxes.
