For 15 years, I served as a leading advocate defending Proposition 13, California\u2019s landmark 1978 property tax limit and the largest property tax cut in history. Now, as a Floridian who escaped California, that experience is exactly why I oppose Florida\u2019s Amendment 3. This is not a question of ideology but of funding mechanics. Large constitutional tax cuts may sound simple, but when they are adopted without a serious replacement plan, the costs do not disappear. They shift.<\/p>\n
The passage of Proposition 13 created an immediate $6-7 billion hole in local government finances, much like what will happen if Amendment 3 passes. In California\u2019s case, legislators largely backfilled that money. With Tallahassee\u2019s fondness for pre-empting local government authority, can we expect the same? Yes, Florida has a surplus right now, but with Amendment 3\u2019s cost ballooning to $12 billion by 2031, what happens when revenue inevitably slows or tourism declines? Florida\u2019s lack of a state income tax means those shifts could fall disproportionately on higher sales taxes. These are profoundly regressive and will hit lower-income Floridians the hardest.<\/p>\n
While not directly caused by Proposition 13, another unintended consequence is the rise of ballot-box budgeting, as California special interests constantly fight to secure their share of the budget pie. Measures include Proposition 98, which requires a minimum of 40% of the budget to go to K-12 education, and another measure that requires the state to provide additional funding for K-12 arts and music education. It can be argued that close to 50% of California\u2019s budget is now tied up by voter mandates, limiting legislators\u2019 budget flexibility. Florida has a chance to learn from that experience before tying its own revenue system and spending priorities to constitutional amendments and initiatives.<\/p>\n
After Proposition 13, local governments adopted various non-ad valorem property taxes, including parcel taxes. These are deeply regressive because owners pay the same flat rate whether they own a small home or a million-dollar mansion, and they can remain on tax bills for decades. More than 300 local, non-school parcel taxes, including those for police and fire services, have been approved in California since 1988, adding hundreds of dollars annually per parcel tax to bills. Florida has largely avoided these punitive taxes so far, but that will likely change if Amendment 3 passes.<\/p>\n
Supporters present Amendment 3 as broad homeowner relief. In reality, the benefits would be uneven. Longtime Florida homeowners stand to gain the most, while many newer residents and first-time buyers may not fully benefit from the expanded exemption because of the amendment\u2019s five-year residency timing rules. That means the tax burden would shift outward \u2014 onto non-homestead property, renters, small businesses and consumers.<\/p>\n
That matters because apartment owners can pass these higher costs on to tenants, and commercial landlords using triple-net leases can pass them on to small businesses. Higher sales taxes or local fees would compound the damage. And when core services like law enforcement, fire protection, and emergency response depend on these unpredictable revenue streams, public safety becomes more vulnerable to economic downturns. Property tax relief is far less compelling if it comes at the expense of safe neighborhoods and reliable emergency services. That is not sound tax reform; it is a formula for picking winners and losers.<\/p>\n
The real lesson of Proposition 13 is that it did not shrink government; it changed how government was funded. Florida should not repeat that mistake by locking in a large tax cut and hoping future lawmakers can fill the hole with hidden fees, higher sales taxes or state bailouts. Vote no on Amendment 3.<\/p>\n
