MIAMI \u2014 The mother of a Hard Rock Cafe server attacked<\/a> at downtown Miami\u2019s Bayside Marketplace says it has been an emotional and difficult week as her daughter recovers from her injuries and a suspect faces a criminal charge.<\/p>\n

The victim\u2019s mother, Luisa, said her daughter is still injured. She suffered a concussion, bruising, and she still has a chipped tooth from the attack, which was caught on camera.<\/p>\n

\u201cEvery time I watch it, like, I cannot believe that they they did this to my daughter,\u201d she said. \u201cI mean, why?\u201d<\/p>\n

Miami police said Daniel Ramirez, 47, of Lubbock, Texas, attacked the server about 30 minutes after she told him he couldn\u2019t snack on drink garnishes in an employee-only area.<\/p>\n

\u201cIt has been very, very hard,\u201d Luisa said. \u201cThis is something that you would never expect any mom to go through. She was just doing her job. She was like not being disrespectful to the customer.\u201d<\/p>\n

Ramirez was taken into custody<\/a> by the Miami Police Department Friday morning at a Royal Caribbean terminal at PortMiami after returning from a cruise. He\u2019s facing a felony battery charge.<\/p>\n

After bonding out of jail<\/a> over the weekend, Ramirez claimed the two merely \u201cran into each other\u201d by \u201caccident.\u201d<\/p>\n

\u201cWhy are you lying? Why did you do this to my daughter?,\u201d Luisa asked.<\/p>\n

A judge ordered Ramirez to stay away from the victim. He told Local 10 News that he\u2019s returning home to Texas.<\/p>\n

\u201cI can\u2019t wait for him to come back to court and for the judge to to do the right thing and to find justice,\u201d Luisa said.<\/p>\n

Luisa has set up a GoFundMe page<\/a> to help pay for her daughter\u2019s medical expenses.<\/p>\n
