Broward College President Torey Alston filed court action Monday seeking to stop a Wednesday vote on whether to terminate him.<\/p>\n
Alston filed a complaint in Broward County Circuit Court for \u201cdeclaratory and injunctive relief,\u201d alleging a violation to his employment contract.<\/p>\n
He argues that the three-year contract requires him and the board to \u201cfirst attempt in good faith to resolve the dispute to their mutual satisfaction, including through formal mediation if requested by either the Board or Alston.\u201d<\/p>\n
\u201cA dispute concerning the Employment Agreement plainly exists,\u201d the court complaint states. \u201cOn August 12, 2026, Plaintiff submitted a written formal complaint alleging, among other things, that his first-year performance evaluation was not administered in accordance with the Employment Agreement, that compensation due under the Agreement was withheld, that Board practices interfered with the presidential authority the Agreement confers, and that he had experienced retaliation for protected activity.\u201d<\/p>\n
Alston is being represented by lawyer David Di Pietro.<\/p>\n
The college\u2019s Board of Trustees has scheduled a special meeting for 8 a.m. Wednesday to consider a motion from Trustee Michael Caschette to terminate Alston without cause.<\/p>\n
Although Caschette declined to state any specific reasons, the move came after several months of tensions between Alston and the trustees over issues such as communication with the board; the low passage rate of Broward College students on nursing exams; computer system issues that created delays and errors in student registrations; and the handling of development on the central campus in Davie, according to meeting minutes.<\/p>\n
The circuit court complaint states that the motion to fire Alston came hours after he filed an internal complaint with the college\u2019s human resources department.<\/p>\n
The college provided documents showing that Alston was informed of the potential trustee action on the evening of Aug. 11, and Alston filed his complaint the next morning on Aug. 12. The public notice of the meeting was published on the evening of Aug. 12.<\/p>\n
