{"id":381575,"date":"2026-08-26T12:28:12","date_gmt":"2026-08-26T12:28:12","guid":{"rendered":"https:\/\/www.newsbeep.com\/us-fl\/381575\/"},"modified":"2026-08-26T12:28:12","modified_gmt":"2026-08-26T12:28:12","slug":"federal-judge-blocks-fius-blanket-ban-on-indoor-student-protests-education","status":"publish","type":"post","link":"https:\/\/www.newsbeep.com\/us-fl\/381575\/","title":{"rendered":"Federal Judge blocks FIU\u2019s blanket ban on indoor student protests | Education"},"content":{"rendered":"<p>A federal Judge has temporarily blocked <a href=\"https:\/\/www.fiu.edu\" target=\"_blank\" rel=\"nofollow noopener\">Florida International University<\/a> from enforcing its sweeping ban on protests inside campus buildings, including disciplinary action taken against students who silently stood against the school\u2019s cooperation with federal immigration authorities this year.<\/p>\n<p>U.S. District Judge Jacqueline Becerra ruled that <a href=\"https:\/\/www.instagram.com\/icebreakersfiu\/\" target=\"_blank\" rel=\"nofollow noopener\">ICEBreakers<\/a> and seven student plaintiffs are likely to prevail in their claim that an FIU <a href=\"https:\/\/regulations.fiu.edu\/wp-content\/uploads\/2025\/11\/FIU-110-2024-11-25.pdf\" target=\"_blank\" rel=\"nofollow noopener\">regulation<\/a> blocking indoor protests violates the First Amendment, as it prohibits expression regardless of whether the actions materially disrupt university operations.<\/p>\n<p>The <a href=\"https:\/\/www.aclufl.org\/app\/uploads\/2026\/08\/2026-08-23-Order-Granting-Pl-AI-Ntiffs-dckt-20_0-1.pdf\" target=\"_blank\" rel=\"nofollow noopener\">preliminary injunction<\/a>, issued in the U.S. District Court of the Southern District of Florida, bars FIU President Jeanette Nu\u00f1ez, Board of Trustees Chair Carlos Duart and their agents from enforcing the regulation against the named students and other ICEBreakers members while the lawsuit proceeds.<\/p>\n<p>It does not formally protect everyone at FIU, although Becerra\u2019s reasoning casts doubt on the regulation\u2019s constitutionality more broadly.<\/p>\n<p>FIU\u2019s rule, <a href=\"https:\/\/regulations.fiu.edu\/wp-content\/uploads\/2025\/11\/FIU-110-2024-11-25.pdf\" target=\"_blank\" rel=\"nofollow noopener\">110(3)<\/a>, prohibits \u201cprotests, parades, marches, picketing, demonstrations, and other similar expressive activities\u201d inside university buildings. Unlike FIU\u2019s rule for outdoor expression, the indoor prohibition does not limit discipline to conduct that materially and substantially disrupts university operations or infringes on others\u2019 rights.<\/p>\n<p>The dispute arose from a March 13 event at FIU\u2019s Modesto Maidique Campus, where Nu\u00f1ez interviewed former baseball star Alex Rodriguez.<\/p>\n<p>About 10 to 15 students wearing \u201cICE OFF FIU\u201d shirts \u2014 referring to U.S. Immigration and Customs Enforcement (ICE) \u2014 stood silently, faced the audience and left. They said nothing and carried nothing. The court said the demonstration lasted no more than a few minutes and the discussion continued without interruption.<\/p>\n<p>An FIU official overseeing the event later said no attendees complained and the protest \u201c<a href=\"https:\/\/www.wlrn.org\/government-politics\/2026-06-17\/fiu-silent-protest-against-ice-policy\" target=\"_blank\" rel=\"nofollow noopener\">did not disrupt the event<\/a>.\u201d Nevertheless, FIU charged seven students. Six ultimately <a href=\"https:\/\/www.local10.com\/news\/local\/2026\/07\/06\/fiu-students-reprimanded-after-silent-ice-protest-during-presidents-speaking-event\/\" target=\"_blank\" rel=\"nofollow noopener\">received written reprimands<\/a> and orders to record two-minute \u201cvideo reflections\u201d explaining their understanding of the rule and how they would apply it.<\/p>\n<p>FIU warned noncompliance could trigger holds blocking class registration, financial aid, transcripts and diplomas.<\/p>\n<p>Becerra\u2019s order stays those sanctions.<\/p>\n<p>\u201cBlocking this regulation means students can start the fall semester without fear of being punished for peacefully protesting,\u201d ICEBreakers President Max Fondren said. \u201cOur work to end FIU\u2019s cruel and unnecessary decision to deputize campus police as ICE agents will continue.\u201d<\/p>\n<p>Citing the U.S. Supreme Court\u2019s landmark 1969 decision in <a href=\"https:\/\/supreme.justia.com\/cases\/federal\/us\/393\/503\/\" target=\"_blank\" rel=\"nofollow noopener\">Tinker v. Des Moines<\/a>, Becerra wrote that the standard has remained unchanged for decades: Student speech may not be curtailed unless it materially disrupts the educational mission, causes substantial disorder or invades others\u2019 rights.<\/p>\n<p>FIU argued it may impose reasonable restrictions to maintain order indoors and said its rule is enforced in a content- and viewpoint-neutral manner. Becerra acknowledged that conduct permissible outdoors could be disruptive inside a classroom, but said the Constitution does not allow FIU\u2019s categorical approach.<\/p>\n<p>\u201cA student can wear a hat, a T-shirt, or as they did in Tinker, an armband to protest,\u201d she wrote. \u201cIn any event, the argument is neither here nor there because even if the Regulation was attempting to limit only disruptive activity, disruptive activity alone fails Constitutional scrutiny.\u201d<\/p>\n<p>The ruling came 12 days after ICEBreakers \u2014 which formed to oppose FIU\u2019s participation in the federal <a href=\"https:\/\/floridapolitics.com\/archives\/816436-federal-judge-blocks-fius-blanket-ban-on-indoor-student-protests\/to%20oppose%20FIU%E2%80%99s%20participation%20in%20the%20federal%20287(g)%20program,%20under%20which%20campus%20police%20may%20perform%20certain%20immigration-enforcement%20functions\" target=\"_blank\" rel=\"nofollow noopener\">287(g) program<\/a>, under which campus police may perform certain immigration-enforcement functions \u2014 and the students <a href=\"https:\/\/www.aclufl.org\/press-releases\/students-sue-florida-international-university-for-violating-their-right-to-protest\/\" target=\"_blank\" rel=\"nofollow noopener\">sued Nu\u00f1ez and other FIU officials<\/a>.<\/p>\n<p>FIU had been warned months earlier that its response was constitutionally suspect.<\/p>\n<p>In a June 18 <a href=\"https:\/\/www.fire.org\/research-learn\/fire-letter-florida-international-university-june-18-2026\" target=\"_blank\" rel=\"nofollow noopener\">letter<\/a>, the Foundation for Individual Rights and Expression <a href=\"https:\/\/floridapolitics.com\/archives\/803537-cleary-protected-expression-free-speech-watchdog-urges-fiu-to-drop-anti-ice-protest-case\/\" target=\"_blank\" rel=\"nofollow noopener\">urged Nu\u00f1ez to drop the conduct cases<\/a> and rewrite what it called an overbroad and vague policy. The organization\u2019s Program Counsel, Garrett Gravley, warned the rule could apply to a Malcolm X shirt, a Palestinian keffiyeh, an Israeli flag lapel pin or purple clothing worn for Domestic Violence Awareness Month.<\/p>\n<p>\u201cClothing is, by its very nature, expressive,\u201d Gravley wrote, arguing FIU could target disruption without prohibiting all indoor protests.
