TALLAHASSEE, Fla. (WCTV) – A Tallahassee woman is suing the Florida Highway Patrol, claiming she sustained severe injuries and damages due to a chase in 2024 involving FHP and another individual.<\/p>\n
WCTV obtained the lawsuit, which revealed that the case was filed Thursday afternoon. The case involves an FHP pursuit that took place back in Sept. 2024 during \u201cheavy rush hour traffic\u201d in Tallahassee, per the records.<\/p>\n
According to the plaintiff, a state trooper initiated a high-speed chase in the area of Lincoln Street. The plaintiff alleges that she was driving in heavy traffic in that area, unaware that the trooper was engaged in the pursuit approaching her location. <\/p>\n
While the suspect was attempting to elude the trooper, the lawsuit claims the suspect lost control of his vehicle at a high rate of speed and \u201cviolently struck several vehicles,\u201d including the plaintiff. As a result, the plaintiff was left with severe injuries and damages, per the court records.<\/p>\n
The complaint alleges FHP of \u201ccommitting one or more\u201d negligent acts, including initiating and continuing a high-speed chase during heavy rush hour traffic in an area densely populated with vehicles, along with failing to discontinue the pursuit \u201cwhen the known risks to the public clearly exceeded the danger of allowing the suspect to escape.\u201d<\/p>\n
Additionally, the court paper accuses the state agency of driving the police vehicle with \u201creckless disregard for safety under the prevailing traffic conditions\u201d and \u201cfailing to adhere to adhere to mandatory departmental emergency vehicle operation and pursuit policies and procedures.\u201d<\/p>\n
\u201cFlorida Highway Patrol, by and through its operational employee\/trooper, owed a duty of reasonable care to the motoring public, including the Plaintiff, to operate law enforcement vehicles and conduct emergency vehicular pursuits in a prudent manner so as not to create an unreasonable risk of harm to innocent motorists.\u201d <\/p>\n
The plaintiff is now requesting judgment for damages against FHP, including compensatory and special damages in excess of $50,000, a jury trial and any other relief the court deems just. <\/p>\n
WCTV is reaching out to FHP and the plaintiff\u2019s attorney for comment.<\/p>\n
