MELBOURNE, Fla. \u2014 An Orlando firefighter who was previously the subject of WFTV coverage<\/a> is facing new DUI-related charges in Brevard County, according to court records.<\/p>\n

Dustin Clark Corby, 38, was arrested Aug. 9 after deputies responded to a home on Ranch Road in Melbourne for a reported battery, according to a criminal complaint filed in Brevard County.<\/p>\n

Deputies said they did not find probable cause for the reported battery, but the encounter led to Corby\u2019s arrest after investigators said they noticed signs of impairment.<\/p>\n

Records show Corby is employed as a firefighter\/paramedic<\/a> with Orlando Fire Rescue. Channel 9 has reached out to Orlando Fire Rescue for comment on Corby\u2019s employment status and whether he remains on duty.<\/p>\n

\u201cWhile the investigation is ongoing we are limited in our ability to comment,\u201d the department said. \u201cHowever, while the investigation is ongoing the firefighter involved has been directed not to drive a city vehicle.\u201d<\/p>\n

The department said it expects its members \u201cto uphold the highest standards of conduct, both on and off duty.\u201d<\/p>\n

What deputies said happened<\/p>\n

According to the criminal complaint, a Brevard County deputy and a field training officer responded to 2625 Ranch Road around 6:26 p.m. Aug. 9.<\/p>\n

Deputies said Corby pulled into the driveway from the public roadway while they were investigating the battery call.<\/p>\n

While speaking with Corby, deputies said they noticed slurred speech, slow movements, bloodshot and glossy eyes, and the odor of alcohol coming from him.<\/p>\n

When deputies asked how much alcohol he had consumed, Corby said he had three beers, according to the complaint.<\/p>\n

The deputy wrote that he suspected Corby was driving under the influence of alcohol and asked him to perform standardized field sobriety exercises.<\/p>\n

Corby declined, according to the complaint.<\/p>\n

The deputy said Corby was told that if he did not perform the exercises, the decision would be based on the totality of the circumstances. Corby still declined to participate, according to the complaint.<\/p>\n

Charges filed<\/p>\n

Court records show Corby was arrested on charges of DUI, refusal to submit to DUI testing and resisting an officer without violence.<\/p>\n

Deputies said Corby tensed his muscles and tried to pull away while he was being handcuffed, leading to the resisting charge.<\/p>\n

The complaint said Corby later refused to provide a breath sample after deputies read him Florida\u2019s implied consent warning.<\/p>\n

He was taken to the Brevard County Jail Complex in Cocoa without further incident, according to the complaint.<\/p>\n

Prior DUI-related arrests<\/p>\n

Court records reviewed by Channel 9 also show prior DUI-related arrests involving Corby.<\/p>\n

In 2012, a Florida Fish and Wildlife Conservation Commission officer arrested Corby on a charge of operating a vessel while impaired after stopping a vessel for operating without navigation lights near Lake Washington Road and Lake Washington Park in Brevard County.<\/p>\n

According to that arrest report, the officer said Corby showed signs of impairment during a vessel safety inspection and refused to submit to a breath test.<\/p>\n

In 2015, the Florida Highway Patrol arrested Corby on a DUI charge after a trooper said he saw a vehicle driving left of center and stopping past stop signs in Melbourne.<\/p>\n

The 2015 arrest report said the trooper smelled alcohol, noticed Corby had red and watery eyes, and said Corby refused field sobriety exercises and a breath test.<\/p>\n

The reports provided to Channel 9 describe arrests and allegations. They do not, by themselves, show the final outcome of each case.<\/p>\n
