(CBS12) \u2014 A dozen new Florida laws are set to take effect Oct. 1, covering everything from license plates and pretrial release to animal cruelty, rental fraud, career offenders and landfill expansion.<\/p>\n<p>1. New penalties for violating pretrial release conditions \u2014 <a href=\"https:\/\/www.flsenate.gov\/Session\/Bill\/2026\/397\" target=\"_blank\" rel=\"nofollow noopener\">HB 397<\/a>The law creates a new first-degree misdemeanor for knowingly violating certain no-contact orders or pretrial release conditions when the original arrest involved a qualifying violent crime.A second or subsequent violation can be charged as a third-degree felony.Officers can make a warrantless arrest when they have probable cause to believe a qualifying violation occurred, and the person must be held until first appearance.2. New criteria for identifying criminal gang members \u2014 <a href=\"https:\/\/www.flsenate.gov\/Session\/Bill\/2026\/429\" target=\"_blank\" rel=\"nofollow noopener\">HB 429<\/a>The law changes the criteria used to determine whether someone is considered a criminal gang member.A person can meet the definition by satisfying at least two specified criteria, including being identified as a gang member or being observed associating with known gang members.The criteria also include certain gang-related communications, online activity, and language signaling gang affiliation or support.<img alt=\"A dozen new Florida laws are set to take effect Oct. 1, covering everything from license plates and pretrial release to animal cruelty and rental fraud. New restrictions on intoxicating substances, &#8220;Meg&#8217;s Law&#8221; \u2014 <a href=\"https:\/\/www.flsenate.gov\/Session\/Bill\/2026\/432\" target=\"_blank\" rel=\"nofollow noopener\">SB 432<\/a><\/p>\n<p>The law prohibits tobacco and nicotine dealers, agents, and employees from possessing, selling, delivering or giving nitrous oxide from licensed premises.Violating the prohibition is a third-degree felony, with certain exceptions for grocery stores, supermarkets and finished food products that use nitrous oxide solely as a propellant.The law also creates new offenses and mandatory penalties related to trafficking xylazine, while exempting certain FDA-approved veterinary uses.<img alt=\"A dozen new Florida laws are set to take effect Oct. 1, covering everything from license plates and pretrial release to animal cruelty and rental fraud. New vehicle, crash-reporting and license-plate rules \u2014 <a href=\"https:\/\/www.flsenate.gov\/Session\/Bill\/2026\/488\" target=\"_blank\" rel=\"nofollow noopener\">SB 488<\/a>The law makes numerous changes involving motor-fuel taxes, vehicle registration, crash reporting and Department of Highway Safety and Motor Vehicles procedures.The apparent-damage threshold for certain crash reports increases from $500 to $2,000.The law also clarifies that license plate frames and decorative borders are allowed as long as they do not obscure the plate number or validation sticker.5. DHSMV customer email addresses get public-records protection \u2014 <a href=\"https:\/\/www.flsenate.gov\/Session\/Bill\/2026\/490\" target=\"_blank\" rel=\"nofollow noopener\">SB 490<\/a>Email addresses collected by the Department of Highway Safety and Motor Vehicles for general customer notifications will receive a public-records exemption.The exemption expands beyond email addresses used specifically for vehicle-registration renewal notices and includes certain vessel title and lien renewal notifications.The exemption is scheduled to repeal Oct. 2, 2031, unless the Legislature renews it.6. Tougher penalties for certain animal cruelty involving minors \u2014 <a href=\"https:\/\/www.flsenate.gov\/Session\/Bill\/2026\/559\" target=\"_blank\" rel=\"nofollow noopener\">HB 559<\/a>The law creates a new third-degree felony when an adult causes or entices a minor to commit certain aggravated animal cruelty, animal fighting or sexual activities involving animals, or commits those acts in the presence of a minor.Minors who commit specified animal-cruelty offenses can be required to undergo psychological evaluation, counseling or treatment.The law also requires FDLE to post certain animal-cruelty conviction information online and establishes a process for seeking removal of qualifying records.7. New specialty license plates and rules for existing plates \u2014 <a href=\"https:\/\/www.flsenate.gov\/Session\/Bill\/2026\/639\" target=\"_blank\" rel=\"nofollow noopener\">HB 639<\/a>Organizations with approved specialty license plates must submit five-year financial projections or risk having the plate deauthorized.The law authorizes several new specialty plates, including plates supporting the Endless Summer, UFC, Miami Northwestern Alumni Association, Christopher Columbus High School and U.S. military academies.Proceeds from the Endless Summer plate will benefit the Surfing\u2019s Evolution &amp; Preservation Corporation.8. Criminal penalties for using false information to enter a rental home \u2014<a href=\"https:\/\/www.flsenate.gov\/Session\/Bill\/2026\/1293\" target=\"_blank\" rel=\"nofollow noopener\"> HB 1293<\/a>Taking possession of a residential dwelling by using a false identity, forged or counterfeit documents or impersonating another applicant becomes a third-degree felony.Landlords can terminate a lease for fraudulent entry as a noncurable violation.A tenant who receives notice must vacate the property within seven days.9. Stricter registration requirements for career offenders \u2014 <a href=\"https:\/\/www.flsenate.gov\/Session\/Bill\/2026\/1332\" target=\"_blank\" rel=\"nofollow noopener\">SB 1332<\/a>Career offenders must register in person with the sheriff\u2019s office within 48 hours after release from incarceration or establishing a residence in Florida.Registration requirements expand to include information such as employment, vehicles, professional licenses, and immigration status.Failing to register or report required changes can result in a separate third-degree felony for each violation.10. New felony for certain sexual acts while observing children \u2014 <a href=\"https:\/\/www.flsenate.gov\/Session\/Bill\/2026\/1525\" target=\"_blank\" rel=\"nofollow noopener\">HB 1525<\/a>The law creates a third-degree felony for intentionally exposing sexual organs or performing certain sexual acts while observing a child under 16 for sexual arousal or gratification.The child does not have to know about or see the offender for the offense to apply.Exceptions include breastfeeding mothers and simple nudity in a location specifically set aside for that purpose.11. New requirements before Monarch Hill landfill can expand \u2014 <a href=\"https:\/\/www.flsenate.gov\/Session\/Bill\/2026\/4039\" target=\"_blank\" rel=\"nofollow noopener\">HB 4039<\/a>Before approving an expansion of the <a href=\"https:\/\/www.wm.com\/us\/en\/facilities\/monarch-hill-landfill\" target=\"_blank\" rel=\"nofollow noopener\">Monarch Hill Landfill<\/a> in Broward County, the county must commission an independent third-party feasibility study.The study must examine issues including environmental and public-health impacts, alternatives, odors, traffic, noise, groundwater contamination and cumulative impacts.A public hearing must be held within a five-mile radius, with advance notice and an opportunity for written and oral testimony.12. Indian River County to take control of Fellsmere Water Control District \u2014 <a href=\"https:\/\/www.flsenate.gov\/Session\/Bill\/2026\/4093\" target=\"_blank\" rel=\"nofollow noopener\">HB 4093<\/a>The law changes the <a href=\"https:\/\/fellsmerewatercontroldistrict.org\/\" target=\"_blank\" rel=\"nofollow noopener\">Fellsmere Water Control District<\/a> from an independent district to a dependent district of Indian River County.The Indian River County Commission becomes the district&#8217;s governing board.The law also revises district boundaries and provisions involving canal maintenance, use and public-record access.The measure takes effect Oct. 1, 2026, if <a href=\"https:\/\/www.flsenate.gov\/Session\/Bill\/2026\/4095\" target=\"_blank\" rel=\"nofollow noopener\">HB 4095<\/a> or similar legislation also takes effect.<\/p>\n","protected":false},"excerpt":{"rendered":"WEST PALM BEACH, Fla.
