The sentencing of Anastasiya Zadorozhna, convicted of vehicular homicide in Cape Coral, was delayed Monday in Lee County after new information revealed her co-defendant, Chase Magruder, may have lied in court. <\/p>\n
“This was new information; apparently, the judge went back and listened to or looked at the record of the sentencing of the codefendant, Mr. Magruder, and learned that Mr. Magruder had actually lied on the stand,” said Rene Suarez, Zadorozhna’s defense attorney. <\/p>\n
Zadorozhna<\/a> and Magruder were reportedly driving nearly 130 miles per hour when police said they crashed into 52-year-old Alberto Almeda<\/a> on Pine Island Road in July 2024<\/a>, killing him<\/a>. Magruder made a deal<\/a> with the State Attorney’s Office last month for a lesser sentence in exchange for his testimony against Zadorozhna. <\/p>\n Judge Bruce Kyle addressed the issue in court, saying, “I listened to the plea the day before, and first there was an implication that there was an agreement. And I don’t recall that being testified to on the stand; in fact, I recall Mr. Magruder saying that we had no agreement.” <\/p>\n Suarez explained the terms of Magruder’s deal, saying, “In exchange for his testimony against my client to basically say that he was racing voluntarily against her and that she knew that he was racing her, he would receive a sentence of one year in the county jail, followed by three years or, I believe, four years of probation.” <\/p>\n However, Magruder reportedly denied having any agreement during his testimony. Judge Kyle called Magruder’s attorney during the hearing and said, “When he was asked if there was an agreement, he said there was not an agreement, so that was not correct. Well, if you have an agreement for a youthful offender, it’s an agreement, is it not?” <\/p>\n Suarez emphasized the significance of this revelation, saying, “This is significant, this was the state’s star witness in the case against Ms. Zadorozhna, and he lied, he lied about something that was very important that I specifically asked him about multiple times.” <\/p>\n Zadorozhna’s attorney stated she could be entitled to a new trial based on this new information and plans to file a motion for that.
