The difference has nothing to do with the passenger’s passport or the ticket price. On the same route, it can come down to one easily overlooked line in the booking: “Operated by.”

Consider Miami-Madrid. American Airlines, Iberia and Air Europa all offer nonstop service between South Florida and the Spanish capital. Under current EU rules, a flight leaving Miami for Madrid is covered only if an EU airline operates it. An Iberia- or Air Europa-operated flight can qualify. An American-operated flight generally does not.

The rules work the other way. A flight from Madrid to Miami falls under EU protections regardless of whether American, Iberia or Air Europa operates it, because the journey begins inside the European Union. The traveler’s nationality does not matter.

Codeshares add another wrinkle. Airlines routinely sell seats under their own flight numbers on aircraft flown by partner carriers. In its official passenger guidance, the EU says the decisive company is the “operating air carrier”.

That means a ticket sold by a European airline from Miami to Madrid does not automatically fall under the EU compensation system if a U.S. carrier operates the flight. Likewise, a ticket bought through a U.S. airline can still carry European protections if an EU carrier operates it.

For a long-haul route such as Miami-Madrid, the EU’s highest compensation tier is 600 euros — about $674 at the European Central Bank’s Oct. 2 reference exchange rate. An arrival delay of at least four hours can qualify for the full amount, while a delay of at least three hours but less than four can bring 300 euros, or roughly half that. Extraordinary circumstances such as severe weather generally relieve airlines of the obligation to pay cash, provided the disruption could not have been avoided even with all reasonable measures.

The U.S. system is different. The Department of Transportation’s current dashboard shows that none of the major U.S. carriers listed commits to cash compensation when a controllable delay lasts three hours or more. Airlines offer varying combinations of meals, hotels and rebooking, while federal refund rules apply separately when passengers decline canceled or significantly disrupted travel.

The contrast comes as Europe prepares to implement a major rewrite of air passenger rights. EU governments gave final approval in July after 13 years of negotiations.

Under the new framework, passengers on qualifying long-haul flights can claim the full top-tier payment after a delay of more than three hours, rather than the lower amount currently applicable between three and four hours. Airlines will also face tighter requirements on information, claims and rerouting. The changes are not yet in force; the Council says they will take effect 12 months and 20 days after publication in the Official Journal.

For Florida travelers, the catch is easy to miss: the direction of a transatlantic trip and the airline actually operating the flight can determine whether a long delay comes with a substantial cash payment.

A delayed flight from Miami to Europe can be worth nearly $700 in compensation — or no guaranteed…

[6
165303,26379,15765,165304,165305,7808,23939,165306,15298,165307,24281,165308,20193,28,30,29,165309,15211,123,165310,807,13318,100395
post-417651","post","type-post","status-publish","format-standard","has-post-thumbnail","category-florida","tag-air-europa","tag-airline-refunds","tag-american-airlines","tag-codeshares","tag-council-of-the-european-union","tag-department-of-transportation","tag-eu","tag-eu-regulation-261-2004","tag-europe","tag-european-central-bank","tag-european-union","tag-flight-compensation","tag-flight-delays","tag-florida","tag-florida-headlines","tag-florida-news","tag-iberia","tag-madrid","tag-miami","tag-passenger-rights","tag-south-florida","tag-spain","tag-transatlantic-flights
["GET
