(WBMA) — A federal judge has dismissed a lawsuit filed by Jacksonville High School coaches, student-athletes and parents challenging recruiting sanctions imposed by the Alabama High School Athletic Association, ruling the dispute was filed in the wrong court.

U.S. District Judge Madeline Hughes Haikala dismissed the case without prejudice Thursday, allowing the plaintiffs to refile their claims in Montgomery County Circuit Court. The ruling does not decide whether AHSAA’s recruiting sanctions were justified or whether its recruiting rules are constitutional.

The lawsuit was filed Sept. 30 by Jacksonville football coach Jeremy Sullivan, volunteer coach Phileepae “Flip” Holloway, two student-athletes and parents. They sued AHSAA and Jacksonville City Schools Superintendent Dr. Michael Barber, in his official capacity, after AHSAA sanctioned the football program over recruiting violations.

As ABC 33/40 previously reported, Sullivan and Holloway were suspended from coaching for one year, while two student-athletes were ruled permanently ineligible to participate in athletics at Jacksonville. AHSAA also fined the school, placed the program on restrictive probation and imposed postseason restrictions.

The federal lawsuit sought emergency court intervention that would allow the students to play and Sullivan and Holloway to coach while the case proceeded. The plaintiffs also asked the court to prevent AHSAA from enforcing other sanctions and its restitution rule. The lawsuit alleged, among other claims, that AHSAA’s recruiting rule violates constitutional protections for speech and association and is unconstitutionally vague.

The plaintiffs called the rule “weaponized,” alleging it is not enforced consistently or fairly. The lawsuit acknowledged phone contacts involving the coaches, players and their families but disputed AHSAA’s conclusion that those communications amounted to recruiting.

Those claims were not resolved by Thursday’s dismissal.

Instead, the federal court sided with AHSAA on a threshold question: where the lawsuit can be heard.

Judge finds venue agreements enforceable

AHSAA argued its handbook and participation agreements contain mandatory provisions requiring lawsuits against the association to be filed in Montgomery County.

The AHSAA handbook states that if a member school or one of its employees or representatives files a lawsuit against the association, the case must be filed in Montgomery County.

Student-athletes and their parents also must sign a “Participant Agreement, Consent, Release, and Venue” form. The agreement states that lawsuits seeking relief affecting a student’s individual or team participation in AHSAA contests must be filed in Montgomery County Circuit Court.

In an earlier filing, AHSAA said its attorneys had not yet obtained the actual forms signed by the plaintiffs because of the speed of the proceedings and initially provided the court with a specimen form.

AHSAA subsequently filed records showing the participation agreements had been electronically signed by the two student-athletes and their parents.

Haikala found the agreements valid and binding.

The judge ruled Sullivan and Holloway are subject to the AHSAA handbook’s requirements through their participation as agents of the school system. She also found the signed participation agreements constitute contracts between AHSAA, the parents and the student-athletes.

The plaintiffs argued the provisions unfairly restrict access to the courts and described them as a “coerced condition of playing athletics at any public school in the State of Alabama.”

Haikala rejected that argument, finding the agreements do not prevent the plaintiffs from going to court but instead establish where their claims must be filed.

The judge also found that requiring the case to proceed in Montgomery would not deprive the plaintiffs of a remedy. She noted the plaintiffs’ attorney is based in Montgomery and said courts there can provide the relief available to them in federal court.

AHSAA argues single venue promotes consistency

In a brief filed before the ruling, AHSAA argued requiring litigation to take place in Montgomery County helps ensure consistent decisions in high school athletics cases across Alabama.

AHSAA’s attorneys contrasted that system with what they described as a “chaotic situation in college athletics right now,” pointing to eligibility rulings by local judges in Mississippi and Louisiana that the filing said were publicly perceived as biased or the product of proverbial “home cooking.”

AHSAA also argued the plaintiffs contributed to the urgency surrounding the case by filing in federal court despite the venue agreements. The association’s attorneys called the plaintiffs “the authors of the very delay against which they inveigh.”

Lawsuit can be refiled

Haikala noted the venue provision covering the coaches is broader and potentially could have allowed their claims to be transferred to the U.S. District Court for the Middle District of Alabama.

The agreements signed by the parents and student-athletes, however, specifically require their claims to be filed in Montgomery County Circuit Court.

Rather than split the case between different courts, Haikala dismissed all of the federal claims so the plaintiffs who choose to continue the legal challenge can refile together in state court.

The judge ordered all pending motions terminated and the federal case closed.

The dismissal leaves the underlying dispute unresolved. The court did not determine whether Jacksonville committed recruiting violations, whether AHSAA properly imposed the sanctions or whether the recruiting rule challenged by the plaintiffs is constitutional.

JACKSONVILLE, Ala.
