A Port St. Lucie man convicted in the Jan. 25, 2025 shooting incident at Miller’s Vapery<\/a> in Stuart was sentenced to 37 \u00bd years in prison, followed by 10 years of probation.<\/p>\n

Circuit Judge Elizabeth Metzger sentenced Joshua Daniel Gibbs, 21, Sept. 30 in the Martin County Courthouse, according to court records.<\/p>\n

Gibbs was convicted of robbery while wearing a mask; attempted robbery with a deadly weapon with a discharge while wearing a mask; aggravated assault with a firearm and mask; shooting or throwing a deadly missile.<\/p>\n

Stuart City Commission voted to form a committee to prioritize how to spend roughly $2.7 million a year in sales tax money earmarked to purchase environmentally sensitive lands like the undeveloped wetlands and scrubby forest seen in this picture on Sept. 28, 2026, just north of Haney Creek Park along Southeast Green River Parkway. What happened?<\/p>\n

Gibbs, who was 19 at the time, was accused of walking into the vape store wearing a black hoodie and a black ski mask and pulling out Glock\u2013style handgun and firing the weapon, a police incident report shows.<\/p>\n

The unidentified employee from the report “fired approximately six rounds” at Gibbs, who then took off without taking anything from the store. Police determined 12 shots were fired, but no injuries were reported.<\/p>\n

While investigating, detectives found it was not Gibbs’ first encounter with the store clerk. In December 2024 Gibbs had been denied service for being underaged, and state law requires customers to be 21 to buy vapes and other nicotine products from a vape store in Florida.<\/p>\n

During that incident Gibbs allegedly threatened the clerk by asking if he “valued his life over his products” before stealing more than $300 worth of vape products.<\/p>\n

With assistance from the U.S. Marshals Fugitive Task Force Gibbs was apprehended on Feb. 7, 2025 in Douglasville, Georgia, and was extradited back to Martin County.<\/p>\n

“The police department received an anonymous tip which led to a photo array which was presented to the victim, and the suspect was positively identified from that photo array,” Bossio told TCPalm in February 2025.<\/p>\n
