The Jaguars deny this occurred.

By the end of 2024, Birdsong’s annual performance review had dropped dramatically — from 4.8 out of 5 to a 2.0, or “meets expectations.”

The complaint alleges the supervisor criticized Birdsong’s “respect” and his “ability to articulate” information, citing the Teams message exchange.

The Jaguars confirm the 2.0 rating in 2024 but deny it was racially motivated.

In November 2024, Birdsong submitted a formal written rebuttal to the review, disputing his supervisor’s criticisms and identifying what he described as unequal application of workplace expectations.

The Jaguars acknowledge the rebuttal was submitted but deny all related allegations.

Exclusion, complaints, termination

Despite the tensions, the Jaguars gave Birdsong a 3% salary increase in March 2025 — a fact both sides confirm.

The following month, the Jaguars’ social and digital media platforms ranked No. 1 among all NFL clubs in total follower growth and total video views, and No. 2 in average TikTok interactions.

But Birdsong alleges that just days later, on April 24, 2025, he was excluded from a critical NFL Draft planning chat and replaced by a white senior digital media manager who reported directly to him.

Birdsong said the supervisor later acknowledged the exclusion but attempted to justify it by drawing a distinction between “social” and “digital” responsibilities. The Jaguars deny this characterization entirely.

On April 28, 2025, Birdsong formally complained to the senior director of marketing that the organization was allowing racial bias to flourish — including permitting white employees to bypass him and undermine his authority over Black subordinates.

The complaint alleges the Jaguars neither investigated the complaint nor took corrective action.

Seven days later, on May 5, 2025, Birdsong was fired. The Jaguars confirm the termination date.

During the meeting, according to the complaint, the team’s executive vice president and chief legal officer told Birdsong the organization was letting him go so he could “feel like you have the opportunity to grow and work with the people you like.”

The Jaguars later stated the firing was the result of a departmental restructuring and performance concerns — reasons that, according to the complaint, were never mentioned during the termination meeting itself.

Birdsong’s lawsuit states he is unaware of any other marketing employee whose position was eliminated in the alleged restructuring. The Jaguars deny these characterizations.

The white social media manager Birdsong had sought equal discipline for in 2024 was retained and promoted following Birdsong’s termination — a timeline both sides confirm.

The legal claims & what Birdsong is seeking

Birdsong filed his complaint after completing the required administrative process.

He filed a charge with the U.S. Equal Employment Opportunity Commission on Sept. 23, 2025. The EEOC issued a right-to-sue notice on June 10, 2026, clearing the way for the federal lawsuit.

The complaint asserts six counts of violations — race discrimination and retaliation — under three separate laws: 42 U.S.C. Section 1981, the Civil Rights Act of 1866; Title VII of the Civil Rights Act of 1964; and the Florida Civil Rights Act.

Birdsong is seeking back pay, lost benefits, front pay, compensatory damages for emotional distress and reputational harm, and punitive damages. He has also demanded a jury trial.

Jaguars mount broad legal defense

The Jaguars, represented by the national law firm Proskauer Rose LLP, responded with a near-total denial and 15 separate affirmative defenses.

Proskauer Rose LLP is a major national firm specializing in employment law and sports.

Among the Jaguars’ defenses to the lawsuit, the team argues:

It acted on legitimate, non-discriminatory business reasons at all times

That Birdsong’s complaints do not legally qualify as “protected activity” under civil rights law

That decision-makers were unaware of his complaints when they made employment decisions

That there is no causal connection between any complaint Birdsong made and his firing

The team also argues that Birdsong has failed to adequately seek new employment to minimize his financial losses, and reserves the right to invoke the “after-acquired evidence doctrine” — a legal principle that could limit damages if the Jaguars uncover during discovery any conduct by Birdsong that would have independently justified his termination.

The Jaguars are asking the court to dismiss all claims with prejudice (meaning permanently — he couldn’t refile) and to award the team its attorney’s fees.

Copyright 2026 by WJXT News4JAX – All rights reserved.

JACKSONVILLE, Fla. – A former Jacksonville Jaguars executive has filed a federal lawsuit against the NFL franchise, claiming…

[8
1930,116,118,117,1630,2159
post-420517","post","type-post","status-publish","format-standard","has-post-thumbnail","category-jacksonville","tag-discrimination","tag-jacksonville","tag-jacksonville-headlines","tag-jacksonville-news","tag-jaguars","tag-money
["GET
