Neighbors say they were afraid to leave their homes after hearing a burst of gunfire in northwest Cape Coral earlier this month.<\/p>\n

One caller told 911 dispatchers the shots<\/a> sounded like someone firing an assault rifle in a backyard.<\/p>\n

\u201cIt\u2019s terrifying the kids. Like, it\u2019s so scary,\u201d the caller said.<\/p>\n

The reported shooting happened Oct. 3 along Northwest 21st Terrace. Cape Coral police said officers found the homeowner, who was reportedly intoxicated. He told an officer he was showing a rifle to a friend, and police said he fired shots into the air.<\/p>\n

Officers reported finding spent shell casings near the front door and on the front lawn, and the report says the man agreed to field sobriety exercises. The officer documented several signs during the tests, including swaying, trouble balancing and difficulty following instructions. <\/p>\n

The report lists these items collected and submitted into evidence: A black Smith & Wesson M&P 15 rifle. A custom black AR-10 rifle, .308 caliber, with no serial number. One 20-round Magpul rifle magazine. One 30-round Magpul rifle magazine. 17 spent .223 shell casings. 9 spent .308 shell casings. <\/p>\n

Gulf Coast News asked the Cape Coral Police Department about the shots that were fired and why no arrest was made yet as of Oct. 16. The response can be read below:<\/p>\n

“Under Florida law, the offense of discharging a firearm in public or on residential property under Florida Statute \u00a7 790.15 is classified as a misdemeanor of the first degree.<\/p>\n

“Because Florida law strictly regulates when officers can make a warrantless arrest, an immediate physical arrest cannot be made on-scene for this specific offense unless the discharge occurred directly in the officer’s presence or falls under a specific statutory exception. Discharging a firearm in public is not listed as a misdemeanor exception under Florida Statute \u00a7 901.15.<\/p>\n

“When officers respond to a reported discharge after the fact\u2014even if shell casings are recovered, witnesses identified a suspect, or physical evidence strongly supports the allegation\u2014officers are legally restricted from making a warrantless physical arrest on the spot.<\/p>\n

“A lack of an immediate, on-scene arrest does not mean the investigation is closed or that the individual will avoid prosecution. Standard legal procedure moves the case forward through the following steps:<\/p>\n

Evidence Collection & Case File: Responding officers document the scene, collect physical evidence (such as shell casings, bullet strikes, or video footage), gather witness statements, and complete an incident report.Direct Filing with the State Attorney’s Office: The complete investigative file is submitted to the State Attorney’s Office (SAO) for formal review.Warrant or Summons: If prosecutors determine that probable cause exists, they file formal charges and request that a judge issue an arrest warrant or a notice to appear\/summons. Once the warrant is signed by a judge, law enforcement can execute the arrest.<\/p>\n

“This incident is being investigated thoroughly and our department is following the appropriate Florida laws to charge this individual accordingly.”<\/p>\n
