A man was arrested after officers with the Cape Coral Police Department say that he hit someone with a baton because they fell over while seated on his motorcycle.<\/p>\n
CCPD says that officers received a call on Wednesday in reference to a physical altercation with injuries.<\/p>\n
When officers arrived on Monday, they spoke with the victim, who told them that he was working on his vehicle with his friend, Sean Kenny, 43. The victim said that at one point, he sat on Kenny’s motorcycle and fell over.<\/p>\n
Kenny, according to the victim, got angry. He reportedly punched the victim in the nose and hit him on the side of his head with an expandable baton.<\/p>\n
Officers noticed injuries to the victim consistent with what he told them. The victim added that the pair has known each other for a while, and that alcohol had been consumed before the incident.<\/p>\n
Officers located and spoke with Kenny at his home. Kenny reportedly denied hitting the victim, saying that he only became upset and kicked him out after the motorcycle had fell.<\/p>\n
Kenny said that the injuries the victim suffered likely came from him falling into a riding mower. He continued to deny any physical altercation with the victim.<\/p>\n
After searching the garage, officers could not find a baton, according to an arrest report. It adds that officers noticed an injury to Kenny’s hand consistent with having punched someone.<\/p>\n
Kenny was arrested. He faces a charge of aggravated battery with a deadly weapon.<\/p>\n
