ORLANDO, Fla. \u2013 A Florida business owner says spam calls have become more than an annoyance: he says they\u2019re overwhelming his phone and interfering with his ability to run his company.<\/p>\n
Brian Wisniewski, who runs River Rave Entertainment, told News 6 he\u2019s dealing with near-constant calls during business hours.<\/p>\n
\u201cI get them about one every two minutes,\u201d he said. \u201cSo by the time I hang up with one and get them to hang up, I\u2019m on a call with another one. It\u2019s continuous all day long from about 9:30 in the morning until 9:00 o\u2019clock at night.\u201d<\/p>\n
Wisniewski said that since last Thursday alone, he\u2019s logged 649 unwanted calls. In one day, he said he received around 170.<\/p>\n
He reached out to News 6 after a previous report on robocalls, saying the volume has made it difficult for legitimate customers to reach him.<\/p>\n
\u201cI\u2019ve had to suspend it until I can get this under control because everybody that needs to get a hold of me can\u2019t reach me,\u201d he said.<\/p>\n
Consumer protection attorney Dor Scwartz with Bernheim Kelley Injury Lawyers said people in Florida may have legal options under federal and state laws \u2014 including the Telephone Consumer Protection Act (TCPA) and Florida\u2019s Telephone Solicitation Act (FTSA).<\/p>\n
\u201cYou can actually sue under those as being a consumer and resident of Florida for each call and text messages that you receive that are unsolicited,\u201d Schwartz said, adding damages can range from $500 to $1,500 per call or text under certain circumstances.<\/p>\n
Wisniewski also said he signed up for the National Do Not Call Registry, but the calls continued.<\/p>\n
Scwartz recommends documenting the calls if you believe you\u2019re being targeted repeatedly: answer the call, tell the caller to stop, and keep records \u2014 including screenshots \u2014 that show the incoming number, date, and time.<\/p>\n
The calls will stop be ordered to stop through any settlement, Scwartz said.<\/p>\n
\u201cWe want the money, right, for our clients, for the harassment,\u201d he said. \u201cBut even more important, we want it to stop. So the company has to agree to stop calling or texting.\u201d<\/p>\n
If calls are coming from outside the United States, attorneys say it is best to let your carrier know, and they can sometimes step in.<\/p>\n
For people who don\u2019t want to pursue legal action, experts suggest checking phone settings for call filtering options that may route suspected spam to voicemail.<\/p>\n
\u201cIt\u2019s not right to be harassed like this over and over with spam calls and robocalls,\u201d Wisniewski said. \u201cIt\u2019s just not fair.\u201d<\/p>\n
