Ronald Lopez Andrade’s sister and mother testified via Zoom on Wednesday, describing a childhood scarred by abuse as his attorneys worked to keep the 37-year-old off death row.

A Miami jury convicted Lopez Andrade of raping and killing Guevara Machado, who was 30, and in October 2024 recommended he be sentenced to death in an 8-4 vote, according to NBC6. The killing happened on April 10, 2016, at the Chesapeake Motel in Hialeah, as reported by the Miami Herald. Guevara Machado was later found dead in a grassy swale near the motel, per the same account.

Miami-Dade Circuit Judge Michelle Delancy, who presided over the case, now holds final authority over whether Lopez Andrade is sentenced to death or to life imprisonment without parole, the Herald’s reporting notes. Prosecutors allege the murder occurred during Lopez Andrade’s rape of Guevara Machado, and they say he confessed to police that he pinned her down, beat her, and covered her mouth during the assault, according to the Herald’s account.

A Chaotic Night at the Motel

According to prosecutors, Lopez Andrade bought beer and cigarettes around 4:30 a.m. that morning and asked motel lobby staff whether he could hire a prostitute, only to be told to find one outside, the Herald reports. Prosecutors say he gave Guevara Machado his shirt while she was wearing only a bra and jeans, and that he made sexual advances toward her before becoming enraged when she refused him.

Jesus Lopez, the defendant’s father, found Guevara Machado’s body at the motel where he worked, the same report states. He has since asked her family for forgiveness and maintains weekly phone contact with his son, per the Herald. Lopez Andrade’s sister, Samantha Solis, testified via Zoom that she prays for Guevara Machado’s family as they endure their grief, while his mother, Alba Andrade, said she stays in touch with her son through frequent calls and is helping raise his children.

Jury Misconduct Upends the First Sentence

The path to this week’s hearing has been anything but straightforward. After the 2024 death recommendation, Lopez Andrade’s attorneys requested a new trial, and the judge ultimately ordered every juror to take the stand under oath to testify about their deliberations, per NBC6’s reporting. One juror alleged that panelists had compared the death penalty in the case to “killing invasive animal species,” NBC6 reported. Delancy denied the request for a new trial but ordered a new penalty-phase hearing, the station noted — though the Herald’s reporting indicates that new sentencing trial never actually took place after Lopez Andrade’s defense chose to forgo it, and prosecutors instead sought to retry the penalty phase using the same aggravating factors from the original trial.

Prosecutors also faced a decision over whether to invoke a newer Florida law mandating death sentences for undocumented immigrants convicted of capital offenses — Lopez Andrade is an undocumented Honduran national. The Miami-Dade State Attorney’s Office opted not to apply it, citing the risk of reversal on appeal, NBC6 reported separately. “We believe that the wisest course of action in this case is to pursue the death penalty with the aggravating factors,” prosecutors said, per that same outlet’s reporting, concluding that the law does not retroactively apply to Lopez Andrade’s 2016 case.

Psychologist Details a Violent Childhood

Forensic psychologist Yenys Castillo, who interviewed Lopez Andrade and his family members in both the United States and Honduras, testified that he grew up in a toxic home where he witnessed the abuse of his mother, according to the Herald. Castillo said his stepfather beat, raped, and threatened his mother with a gun, and that his mother was not emotionally available while depending on her son to keep her safe. His father, meanwhile, was absent after moving from Honduras, per Castillo’s testimony, and Lopez Andrade grew up in a neighborhood marked by gun and gang violence.

Castillo testified that Lopez Andrade learned to suppress his emotions through work and excessive drinking as a result of that childhood trauma, and that he still has difficulty identifying, labeling, and expressing negative emotions. She said he disconnects in stressful situations and represses his feelings, and recounted that when asked about the jury’s death recommendation, he said he was not important. Judge Delancy, who presided over the proceedings, described Lopez Andrade’s demeanor at trial as flat. The defense rested its case following Castillo’s testimony.

What the Jury Didn’t Find — and What Comes Next

Notably, the jury did not find that the murder was heinous, atrocious, and cruel, the Herald reported. Under Florida Statutes Section 921.141, a jury must unanimously find at least one aggravating factor beyond a reasonable doubt for a defendant to be eligible for death, and the statute specifically lists committing a capital felony during a sexual battery as one such factor. If at least eight jurors determine death is warranted, the recommendation must be death — the threshold Lopez Andrade’s jury met in 2024.

Lopez Andrade has not yet been sentenced following that recommendation, and the next hearing in the case is scheduled for December 7. The motel itself has its own troubled legal history: a Florida appeals court affirmed a $12 million wrongful-death verdict against The Waves of Hialeah, Inc., the property’s owner, after Guevara Machado’s parents, Julia Machado and Rafael Guevara, sued for negligent security, with jurors finding the motel wholly at fault, according to court records.

Ten years after Yaimi Guevara Machado was raped and beaten to death at a Hialeah motel, the family…

[15
225,227,226
post-442538","post","type-post","status-publish","format-standard","has-post-thumbnail","category-hialeah","tag-hialeah","tag-hialeah-headlines","tag-hialeah-news
["GET
