the suspect in her 2011 disappearance<\/a>, has officially been charged in the Ninth Circuit with Parker’s murder. <\/p>\nOrange-Osceola State Attorney Monique Worrell on Tuesday filed a charge of second-degree murder against Smith, even though Parker’s body has never been found. <\/p>\n
Smith has filed a motion for a specialized bond hearing, or “Arthur hearing,” arguing in large part that the state is unable to connect him to the killing \u2014 “let alone one that satisfies every element of second-degree murder,” the motion states \u2014 adding he is entitled to due process, should be presumed innocent, and should immediately be released on a monetary bond. <\/p>\n
“Under Florida Law, Second-Degree Murder requires the State to prove that Ms. Parker is dead, that her death was caused by Mr. Smith’s act, and that the unlawful killing resulted from an act imminently dangerous to another and demonstrating a depraved mind without regard for human life,” the filing states. <\/p>\n
Parker vanished on Nov. 17, 2011, the same day she and Smith appeared on a taped episode of “The People’s Court” arguing over a lost engagement ring. <\/p>\n
She was last known to be alive when she was dropping off her twin children at Smith’s condo near Goldenrod Road and Lee Vista Boulevard in Orlando, police said. <\/p>\n
Parker’s Hummer was found on Nov. 18, 2011, in an Orlando parking lot, and sheriff’s divers discovered her iPhone under an Orange County bridge in December 2011. <\/p>\n
Smith is the only suspect in the case but was never criminally charged until recently. <\/p>\n
Parker’s family has pleaded for answers from Smith’s family. In 2013, Parker’s mother, Yvonne Stewart, asked Tamara Smith, the mother of Dale Smith Jr., to come forward using Crimeline. <\/p>\n
Smith has denied having anything to do with the disappearance. <\/p>\n
Prosecutors previously persuaded a judge to seal the arrest warrant documents, keeping details about the evidence against Smith from the public. <\/p>\n
The arrest affidavit has since been unsealed, showing police used texts, driving records and a history of violence to link Smith to Parker’s death. <\/p>\n
The 46-page arrest affidavit details a history of domestic violence \u2014 most of which was not reported to authorities. Their relationship was described as “tumultuous,” with Smith often being violent and controlling toward Parker. <\/p>\n
Regarding the episode of “The People’s Court,” the affidavit states “both the raw footage and the aired footage were not flattering to either the suspect or the victim.” <\/p>\n
Smith said he believed Parker was embarrassed by the episode and said she was “just laying low,” adding he had no idea if anything happened to her at all, according to the documents. <\/p>\n
Following the interview with police, Smith allowed photos to be taken that show scratches and abrasions that detectives believe were defense wounds from Parker.<\/p>\n
