{"id":46270,"date":"2025-11-14T08:24:23","date_gmt":"2025-11-14T08:24:23","guid":{"rendered":"https:\/\/www.newsbeep.com\/us-fl\/46270\/"},"modified":"2025-11-14T08:24:23","modified_gmt":"2025-11-14T08:24:23","slug":"plaintiffs-to-appeal-ruling-that-allowed-frank-carollo-to-stay-on-miami-runoff-ballot","status":"publish","type":"post","link":"https:\/\/www.newsbeep.com\/us-fl\/46270\/","title":{"rendered":"Plaintiffs to appeal ruling that allowed Frank Carollo to stay on Miami runoff ballot"},"content":{"rendered":"<p style=\"text-align: justify;\">As expected, the battle over whether former City Commissioner Frank Carollo can stay on Miami\u2019s runoff ballot isn\u2019t over.<\/p>\n<p style=\"text-align: justify;\">One day after a Miami-Dade Circuit Judge <a href=\"https:\/\/floridapolitics.com\/archives\/765304-frank-carollo-to-remain-on-miami-runoff-ballot-after-judges-ruling\/\" data-wpel-link=\"internal\" target=\"_blank\" rel=\"noopener noreferrer nofollow\">ruled Carollo could remain<\/a> in the Dec. 9 contest despite new lifetime term limits that would otherwise bar him from holding office, the plaintiffs in the case are appealing.<\/p>\n<p style=\"text-align: justify;\">Miami voters Victor Milanes, Alex Almirola and Oscar Alejandro \u2014 the latter of whom placed third on Nov. 4 behind Carollo and runoff candidate Rolando Escanola for the Commission\u2019s District 3 seat \u2014 have filed a <a href=\"https:\/\/cloudup.com\/c2kh6kDIs0x\" data-wpel-link=\"external\" target=\"_blank\" rel=\"external noopener noreferrer nofollow\">notice of appeal<\/a> for the ruling.<\/p>\n<p style=\"text-align: justify;\">The notice, filed Thursday morning with the 3rd District Court of Appeal, again names lawyers J.C. Planas and Natalie Kano as the plaintiffs\u2019 legal representation.<\/p>\n<p style=\"text-align: justify;\">Those on the service list include Carollo\u2019s lawyer, Robert Fernandez; Lydecker partner Forrest Andrews, who is representing Miami; Assistant City Attorney Eric Eves; Miami-Dade Elections General Counsel Oren Rosenthal; Escalona\u2019s lawyer, Peter Solnick; and lawyers representing <a href=\"https:\/\/floridapolitics.com\/archives\/763690-its-not-over-eileen-higgins-emilio-gonzalez-to-compete-in-runoff-for-miami-mayor\/\" data-wpel-link=\"internal\" target=\"_blank\" rel=\"noopener noreferrer nofollow\">mayoral runoff<\/a> candidates Emilio Gonz\u00e1lez and Eileen Higgins.<\/p>\n<p style=\"text-align: justify;\">Voters this month <a href=\"https:\/\/floridapolitics.com\/archives\/763798-christine-king-re-elected-to-miami-commission-as-race-for-district-3-seat-heads-to-runoff\/\" data-wpel-link=\"internal\" target=\"_blank\" rel=\"noopener noreferrer nofollow\">overwhelmingly approved<\/a>\u00a0a charter amendment imposing a lifetime limit of two four-year terms for City Commissioners and Mayors, a change the plaintiffs argued should disqualify Carollo from the ballot.<\/p>\n<p style=\"text-align: justify;\">Carollo led the Nov. 4 race for the District 3 seat with\u00a0<a href=\"https:\/\/floridapolitics.com\/archives\/763798-christine-king-re-elected-to-miami-commission-as-race-for-district-3-seat-heads-to-runoff\/\" data-wpel-link=\"internal\" target=\"_blank\" rel=\"noopener noreferrer nofollow\">38% of the vote<\/a>, but fell short of the majority needed to win outright, placing him in a runoff with Escalona, a restaurant manager and fellow Republican who <a href=\"https:\/\/floridapolitics.com\/archives\/763046-rolando-escalona-to-remain-in-miami-commission-race-after-judge-rules-his-residency-is-legit\/\" data-wpel-link=\"internal\" target=\"_blank\" rel=\"noopener noreferrer nofollow\">faced a separate lawsuit last month<\/a> challenging his residency bona fides.<\/p>\n<p style=\"text-align: justify;\">Milanes, Almirola and Alejandro, a Democrat who hopes to take Carollo\u2019s place on the ballot, <a href=\"https:\/\/floridapolitics.com\/archives\/764130-voters-sue-to-enforce-miamis-new-lifetime-term-limits-boot-frank-carollo-from-runoff\/\" data-wpel-link=\"internal\" target=\"_blank\" rel=\"noopener noreferrer nofollow\">sued after the election<\/a> last week to boot Carollo from the ballot. They argued that allowing \u201ca candidate who already served two full terms to continue in a runoff would directly undermine\u201d the new term limits \u201cand risk nullifying the very reform voters just enacted.\u201d<\/p>\n<p style=\"text-align: justify;\">Fernandez, Carollo\u2019s lawyer, successfully contended that removing him now would be unconstitutional and disenfranchise voters who supported him and the referendum.<\/p>\n<p style=\"text-align: justify;\">Miami-Dade Circuit Judge Peter Lopez sided with the defense. He said the court would not interfere with an ongoing election and said voters, not the judiciary, should decide Carollo\u2019s fate.<\/p>\n<p style=\"text-align: justify;\">Carollo and Escalona are competing for the right to succeed Carollo\u2019s brother, Joe Carollo, who has held the District 3 seat since 2017. Frank Carollo previously served in the seat from 2009 to 2017.<\/p>\n<p style=\"text-align: justify;\">By the time the appeal is decided, it may be too late to intervene before Election Day. Rosenthal cautioned Monday that ballots for the city\u2019s runoff were already being printed.
