The move comes as Williamson is expanding the fees the Village charges to access public records.\u00a0 <\/p>\n<p>The media policy resolution in front of the Council has not been agreed to by the Independent, according to court records.\u00a0<\/p>\n<p>A court filing states the parties \u201chave been unable to reach a settlement agreement \u201d despite negotiations. \u00a0The Independent is represented by lawyers from the <a href=\"https:\/\/www.rcfp.org\/litigation\/miami-fourth-estate-v-key-biscayne\/\" rel=\"nofollow noopener\" target=\"_blank\">Reporters Committee of Freedom of the Press,<\/a> a nationally known media freedom organization, and the law firm Shullman Fugate.<\/p>\n<p><a href=\"https:\/\/legistarweb-production.s3.amazonaws.com\/uploads\/attachment\/pdf\/3740689\/4CB5528-Resolution_11.12.pdf\" rel=\"nofollow noopener\" target=\"_blank\">The resolution<\/a> for Tuesday\u2019s meeting expresses the Village\u2019s \u201cintent\u00a0 to not have a binding media policy\u201d but does not limit Williamson\u2019s power to enact one in the future.\u00a0\u00a0<\/p>\n<p>Williamson is also asking elected leaders to approve the resolution without discussion by placing it on the \u2018consent\u2019 agenda, reserved for noncontroversial matters. The resolution was pulled from the agenda for October\u2019s meeting after Council Member Ed London objected.<\/p>\n<p>The \u201cVillage Council supports the Village Manager in his efforts to ensure such clarity in messaging and promoting efficiency in the services that the Village provides to the public,\u201d the proposed resolution reads.<\/p>\n<p>\u201cWe made every effort to resolve this through negotiation,\u201d said Tony Winton, editor in chief of the Independent. He said the resolution doesn\u2019t promote transparency because it still allows the manager to institute a media policy.<\/p>\n<p>\u201cDecisions on transparency and public information are critical policy matters that the Council itself should decide, not delegate to the manager with unclear wiggle words,\u201d Winton said.<\/p>\n<p>\u201cThis is an opportunity for the Council to speak clearly.  It should affirm, directly, the right of the public to speak to Village staff and get information \u2013 and the right of employees to serve the public interest by giving the public accurate information.\u201d<\/p>\n<p>Without an agreement between the parties, U.S. District Court Judge Ed Artau ordered Friday that the federal lawsuit continue. Both sides were directed to start briefing the court on issues related to the civil rights claim.<\/p>\n<p>  Never miss a story! He previously served on the 4th District Court of Appeal (Florida Courts via KBI)<\/p>\n<p>The Independent<a href=\"https:\/\/kbindependent.org\/2025\/06\/25\/federal-lawsuit-challenges-unconstitutional-key-biscayne-media-policy\/\" rel=\"nofollow noopener\" target=\"_blank\"> filed a federal lawsuit in June<\/a> against the Village challenging Williamson\u2019s media policy. It forbade any employee from speaking to the press without first getting consent from him or Jessica Drouet, Key Biscayne\u2019s spokesperson. Williamson informed staff that if they spoke to reporters without consent, they could face disciplinary action up to and including dismissal.<\/p>\n<p>The Society of Professional Journalists has called such policies \u201cCensorship by PIO.\u201d<\/p>\n<p>Fees for Public Records<\/p>\n<p>In another development, Williamson told the Independent Thursday he is adopting a new policy for public records that will charge media outlets \u2014 and the public \u2014 more money to access records.<\/p>\n<p><img loading=\"lazy\" decoding=\"async\" width=\"800\" height=\"533\" src=\"https:\/\/www.newsbeep.com\/us-fl\/wp-content\/uploads\/2025\/11\/Village-Hall-exterior-0172.jpg\" alt=\"exterior of office building\" class=\"wp-image-14387\"  \/>FILE \u2013 Village Hall, Key Biscayne, seen Feb. 26, 2022. (KBI Photo\/Theo Miller)<\/p>\n<p>At issue is the Independent\u2019s standing request for routine copies of Williamson\u2019s emails \u2013 emails that have been transmitted to the publication without charge every week since at least 2023.<\/p>\n<p>In an email, Williamon\u00a0 claimed providing the emails was \u201cextensive staff work\u201d and asserted, without evidence, that state law defines \u2018extensive\u2019 as anything over 15 minutes.<\/p>\n<p>But Barbara Petersen, a public records expert who runs the <a href=\"https:\/\/flcga.org\/\" rel=\"nofollow noopener\" target=\"_blank\">Florida Center for Government Accountability<\/a>, said no statute defines extensive work as 15 minutes.<\/p>\n<p>There is no legal definition of\u00a0 \u2018reasonable\u2019 other than a court\u2019s definition that says \u201creasonable\u201d means the time it takes to locate the requested records, review those records for exempt information and provide a copy,\u201d Peterson said.<\/p>\n<p>Big Dig, Rickenbacker on Agenda <\/p>\n<p>Besides the media policy, the Village has a meaty agenda for Tuesday:<\/p>\n<p>\u25cf\u00a0 The final reading of an ordinance to apply for a state loan of $60 million to pay for the Big Dig project.<\/p>\n<p>\u25cf\u00a0 A resolution to approve a $950,000 no-bid contract for a study on the feasibility of the ambitious renovation of the Rickenbacker Causeway called the \u201cShoreline.\u201d <br \/>County Commissioner Raquel Reglado, who is pushing the overhaul, is expected to attend. The viaduct plan over Virginia Key has been greeted warmly by council members so far, but on the <a href=\"https:\/\/www.buzzsprout.com\/1186931\/episodes\/18187548\" rel=\"nofollow noopener\" target=\"_blank\">Anti-Social podcast<\/a> last week, Miami-Dade Mayor Daniella Levine Cava sounded less than enthused about it.<\/p>\n<p>\u25cf\u00a0 The Council will choose a new vice mayor for 2026.\u00a0 Oscar Sardi\u00f1as is currently in a position that has often rotated among Council members.\u00a0<\/p>\n<p><a href=\"https:\/\/kbindependent.org\/give\/\" rel=\"nofollow noopener\" target=\"_blank\">Invest in Local News for Your Town.
