A woman filed a lawsuit after she said she was hit by a duck while she rode the Mako roller coaster at Sea World, but the theme park\u2019s lawyers said it wasn\u2019t a duck at all. <\/p>\n
WFTV<\/a> reported that SeaWorld\u2019s legal team was instead hit by a Snowy Egret. <\/p>\n \u201cThis matter does not and has never involved a duck,\u201d the parks\u2019 lawyers wrote in a court filing. <\/p>\n Hillary Martin sued SeaWorld, saying the park had created a \u201czone of risk\u201d by building a coaster near where birds congregate. <\/p>\n The park called her accusation speculative and without legal basis. <\/p>\n \u201cThe duck\u2019s presence in the air, away from the alleged water source, negates any plausible relationship between Sea World\u2019s premises and Plaintiff\u2019s alleged injury,\u201d SeaWorld\u2019s attorney wrote, according to WFTV<\/a>. \u201cMartin\u2019s event, by its own description, could have occurred regardless of the presence or absence of any body of water within the park, and it still would not have been Sea World\u2019s legal responsibility.\u201d<\/p>\n They also said that she had refused medical treatment because she didn\u2019t want to take time away from the park. She did receive treatment the next day, SeaWorld\u2019s lawyers said. <\/p>\n The park\u2019s lawyers are asking that the lawsuit be thrown out, saying it had no legal responsibility for the Egret since it didn\u2019t control the bird.<\/p>\n A Snowy Egret feeds in shallow waters and lives on coasts, shorelines, freshwater wetlands, lakes, ponds, rivers and saltwater wetlands. They can be found in Florida, California, the Great Lakes, New England and other parts of North America, according to the Audubon Society<\/a>. <\/p>\n They are between 20 and 27 inches, or about the size of a mallard, Herring Gull or heron, the society<\/a> said.<\/p>\n
