Credit: USFWS<\/p>\n<p>The Trump Administration has proposed new changes to the <a href=\"https:\/\/www.fws.gov\/law\/endangered-species-act\" target=\"_blank\" rel=\"noopener nofollow\">Endangered Species Act<\/a> (ESA). Some conservation organizations oppose the proposed changes to the ESA because they may harm the conservation of species, especially in Florida.\u00a0<\/p>\n<p>Elise Bennett is the Florida and Caribbean director of the<a href=\"https:\/\/www.biologicaldiversity.org\/\" target=\"_blank\" rel=\"noopener nofollow\"> Center for Biological Diversity<\/a>. She said these new changes will make it very hard to protect every species and ecosystem across the country.<\/p>\n<p>She said these changes will reset how the U.S. Fish and Wildlife Service can reasonably assess what species are at risk, what is threatening them, and how conservation organizations can help.<\/p>\n<p>The Center for Biological Diversity said in a press release that the<a href=\"https:\/\/myfwc.com\/wildlifehabitats\/profiles\/reptiles\/freshwater-turtles\/alligator-snapping-turtle\/\" target=\"_blank\" rel=\"noreferrer noopener nofollow\"> alligator snapping turtle<\/a>, <a href=\"https:\/\/www.fws.gov\/species\/california-spotted-owl-strix-occidentalis-occidentalis\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">California spotted owls,<\/a> <a href=\"https:\/\/www.fws.gov\/story\/2022-04\/florida-panther\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">Florida panthers<\/a>, <a href=\"https:\/\/www.fws.gov\/species\/monarch-danaus-plexippus\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">monarch butterflies<\/a>, <a href=\"https:\/\/www.fws.gov\/species\/saltmarsh-sparrow-ammodramus-caudacutus\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">saltmarsh sparrow,<\/a> <a href=\"https:\/\/www.fisheries.noaa.gov\/species\/sunflower-sea-star\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">sunflower sea star<\/a> and the <a href=\"https:\/\/defenders.org\/blog\/2024\/01\/wolverines-where-they-live-and-why-theyre-endangered\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">wolverine<\/a> will be in jeopardy of extinction.<\/p>\n<p>\u201cIt\u2019s so important, you know, that\u2019s why we\u2019re pointing out that many of these regulations are unlawful. They\u2019re contrary to the Endangered Species Act, and they could have really massive impacts on everyday Americans who care about going to wild places and just care about having a healthy ecosystem to depend on,\u201d Bennett said.<\/p>\n<p>Proposed change to <a href=\"https:\/\/www.regulations.gov\/document\/FWS-HQ-ES-2025-0039-0001\" rel=\"nofollow noopener\" target=\"_blank\">Section 4<\/a>:\u00a0<\/p>\n<p>As of right now, Bennett said under the Act, a species doesn\u2019t get any protection until it\u2019s added to a list of endangered and threatened species. This is done by considering the best available science about these species and their threats.<\/p>\n<p>\u201cOne thing the statute says is that these decisions should be made solely on the best available science, and that means we\u2019re only looking at the species and the impact of the species. We shouldn\u2019t be looking at economic considerations of impacts to industry and the statue is quite clear on what that means,\u201d Bennett said.<\/p>\n<p>She said that if you start thinking about the impacts of water bottle industries, groundwater pumping and agriculture, a species would have a difficult time to get listed.<\/p>\n<p>Proposed change to<a href=\"https:\/\/www.regulations.gov\/document\/FWS-HQ-ES-2025-0048-0001\" target=\"_blank\" rel=\"noopener nofollow\"> Section 4b<\/a>:<\/p>\n<p>Bennett said the Trump Administration is trying to change the way agencies would protect habitat for species.<\/p>\n<p>\u201cWe call it critical habitat under the law, and critical habitat is habitat that\u2019s essential for the survival and recovery of the species,\u201d she said.<\/p>\n<p>Bennett said under the new proposal, it would prohibit the designation or protection of habitat for species threatened by climate change or other threats that can\u2019t be addressed by agency permitting.<\/p>\n<p>\u201cIf you think about the Florida Keys, we have the <a href=\"https:\/\/www.fws.gov\/refuge\/national-key-deer\" target=\"_blank\" rel=\"noopener nofollow\">key deer<\/a>, the <a href=\"https:\/\/www.fws.gov\/species\/florida-keys-mole-skink-eumeces-egregius-egregius\" target=\"_blank\" rel=\"noopener nofollow\">Florida Keys mole skink<\/a>, the <a href=\"https:\/\/saveplants.org\/plant-profile\/?CPCNum=15862\" target=\"_blank\" rel=\"noopener nofollow\">key tree cactus<\/a>, and many other plans and animals that are existentially threatened by sea level rise driven by climate change,\u201d Bennett said.<\/p>\n<p>She said that if they can\u2019t protect areas of habitat were climate change is coming, species would have no chance of survival.<\/p>\n<p>The new regulation will also take away the ability to protect habitat outside the species occupied range.<\/p>\n<p>Proposed change to <a href=\"https:\/\/www.regulations.gov\/document\/FWS-HQ-ES-2025-0044-0001\" target=\"_blank\" rel=\"noopener nofollow\">Section 7<\/a>:<\/p>\n<p>Bennett said the current language, in this section, allows agencies to make reasonable and reliable predictions of the future of a species. But the new changes will affect how the U.S. Fish and Wildlife Service can look at the future of a species<\/p>\n<p>\u201cThey would rest this entire determination on the agency\u2019s ability to reasonably determine what threats are and how the species will respond. The language suggests that if they can\u2019t determine for sure what the threats are, or if they don\u2019t know what the species likely response is, they can\u2019t do anything to help,\u201d Bennet said.<\/p>\n<p>She said organizations will have to sit and wait as the species continues to die off before being able to help.<\/p>\n<p>\u201cThe longer we wait, if we wait till there\u2019s only a handful of these species left in the wild, then you have to have captive breeding programs. It\u2019s really expensive and there\u2019 more risk of failure,\u201d Bennett said.<\/p>\n<p>Overall impact on Florida if changes pass<\/p>\n<p>\u201cThe major concern right now is that it will be a whole lot harder to protect each and every species, but also entire ecosystems, that are across the country but especially here in Florida,\u201d Bennett said.<\/p>\n<p>An example she used is how her organization is petitioning to list <a href=\"https:\/\/www.evergladesfoundation.org\/post\/10-things-you-didn-t-know-about-florida-manatees-and-where-to-see-them?gad_source=1&amp;gad_campaignid=13513402480&amp;gbraid=0AAAAABcDl6Fq_5B3RTTuTeBB99RDj28tU&amp;gclid=Cj0KCQiAubrJBhCbARIsAHIdxD8oQjUn_IyKb9KJJfkYefLo3diJ-9cW73XgLiPj3AYnfTmGqo_yI_YaAjwHEALw_wcB\" target=\"_blank\" rel=\"noopener nofollow\">Florida Manatees<\/a> as endangered. If these changes pass, they are concerned the manatees will not receive strong protections from activities that kill, harm and harass them.<\/p>\n<p>The Center for Biological Diversity said in a press release that the<a href=\"https:\/\/myfwc.com\/wildlifehabitats\/profiles\/reptiles\/freshwater-turtles\/alligator-snapping-turtle\/\" target=\"_blank\" rel=\"noreferrer noopener nofollow\"> alligator snapping turtle<\/a>, <a href=\"https:\/\/www.fws.gov\/species\/california-spotted-owl-strix-occidentalis-occidentalis\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">California spotted owls,<\/a> <a href=\"https:\/\/www.fws.gov\/story\/2022-04\/florida-panther\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">Florida panthers<\/a>, <a href=\"https:\/\/www.fws.gov\/species\/monarch-danaus-plexippus\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">monarch butterflies<\/a>, <a href=\"https:\/\/www.fws.gov\/species\/saltmarsh-sparrow-ammodramus-caudacutus\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">saltmarsh sparrow,<\/a> <a href=\"https:\/\/www.fisheries.noaa.gov\/species\/sunflower-sea-star\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">sunflower sea star<\/a> and the <a href=\"https:\/\/defenders.org\/blog\/2024\/01\/wolverines-where-they-live-and-why-theyre-endangered\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">wolverine<\/a> will be at jeopardy of extinction if the regulations pass.<\/p>\n<p>\u201cBy gutting these laws, the only people this is helping are the industry.\u201d<\/p>\n<p>Bennett\u2019s organization, along with others, are asking for an extension to review the proposed regulations.\u00a0The deadline for <a href=\"https:\/\/act.biologicaldiversity.org\/nXrxsHJM-USwgTWVogrJjg2?sourceid=1010370&amp;oa_ad_referrer=action-alerts&amp;utm_source=website&amp;utm_medium=web&amp;utm_campaign=action-alerts&amp;_gl=1*htij66*_gcl_au*Nzc4NjE0MDY4LjE3NjM1NjI4NDE\" target=\"_blank\" rel=\"noopener nofollow\">public comment<\/a> is December 22.<\/p>\n<p>\u200b<\/p>\n<p>\u200b<\/p>\n","protected":false},"excerpt":{"rendered":"Manatee resting at Crystal River National Wildlife Refuge.
