{"id":80537,"date":"2025-12-12T06:54:20","date_gmt":"2025-12-12T06:54:20","guid":{"rendered":"https:\/\/www.newsbeep.com\/us-fl\/80537\/"},"modified":"2025-12-12T06:54:20","modified_gmt":"2025-12-12T06:54:20","slug":"did-not-impact-the-sentence-orange-osceola-state-attorney-addresses-oversight-in-orlando-jogger-attack-case","status":"publish","type":"post","link":"https:\/\/www.newsbeep.com\/us-fl\/80537\/","title":{"rendered":"\u2018Did not impact the sentence:\u2019 Orange-Osceola state attorney addresses \u2018oversight\u2019 in Orlando jogger attack case"},"content":{"rendered":"<p class=\"dist__Box-sc-1fnzlkn-0 dist__TextBase-sc-1fnzlkn-3 bYFsJw cuqaEv article-text\">ORLANDO, Fla.  \u2013 Orange-Osceola State Attorney Monique Worrell held a news conference on Thursday to address \u201can oversight by the prosecutor\u201d in a <a href=\"https:\/\/www.clickorlando.com\/news\/local\/2025\/12\/10\/prosecutor-pinned-for-oversight-after-man-accused-in-orlando-jogging-attack-takes-plea-deal\/\" target=\"_blank\" rel=\"noreferrer nofollow noopener\" title=\"https:\/\/www.clickorlando.com\/news\/local\/2025\/12\/10\/prosecutor-pinned-for-oversight-after-man-accused-in-orlando-jogging-attack-takes-plea-deal\/\">plea deal for a man accused of attacking a jogger<\/a> near College Park.<\/p>\n<p class=\"dist__Box-sc-1fnzlkn-0 dist__TextBase-sc-1fnzlkn-3 bYFsJw cuqaEv article-text\">The state attorney\u2019s office said it\u2019s reviewing the prosecutor\u2019s decision to withhold adjudication against Tyler Feight, 26, who was <a href=\"https:\/\/www.clickorlando.com\/news\/local\/2025\/04\/10\/suspect-arrested-in-attack-on-jogger-near-orlandos-college-park\/\" target=\"_blank\" rel=\"nofollow noopener\" title=\"https:\/\/www.clickorlando.com\/news\/local\/2025\/04\/10\/suspect-arrested-in-attack-on-jogger-near-orlandos-college-park\/\">arrested in April<\/a> after a woman reported being attacked near College Park in Orlando.<\/p>\n<p class=\"dist__Box-sc-1fnzlkn-0 dist__TextBase-sc-1fnzlkn-3 bYFsJw cuqaEv article-text\">A decision to withhold adjudication means there is no formal conviction in a case. Worrell told reporters that the prosecutor assigned to this particular case checked the box to \u201cwithhold adjudication,\u201d a box she said the prosecutor did not mean to check.<\/p>\n<p class=\"dist__Box-sc-1fnzlkn-0 dist__TextBase-sc-1fnzlkn-3 bYFsJw cuqaEv article-text\">\u201cRather than checking \u2018adjudication,\u2019 he checked \u2018withhold of adjudication,\u2019\u201d Worrell said. \u201cAnd he shouldn\u2019t have. He should\u2019ve checked \u2018adjudication.\u2019\u201d<\/p>\n<p class=\"dist__Box-sc-1fnzlkn-0 dist__TextBase-sc-1fnzlkn-3 bYFsJw cuqaEv article-text\">News 6\u2019s Mike Valente followed up on Worrell\u2019s answer by asking whether that decision was reviewed in court before a judge signed off on Feight\u2019s plea deal.<\/p>\n<p class=\"dist__Box-sc-1fnzlkn-0 dist__TextBase-sc-1fnzlkn-3 bYFsJw cuqaEv article-text\">\u201cI can\u2019t answer that because I haven\u2019t reviewed any video of what happened in court,\u201d Worrell said. \u201cBut I can tell you that typically plea offers are read to the court and the court accepts or rejects the plea based on the agreement reached between the parties.\u201d<\/p>\n<p class=\"dist__Box-sc-1fnzlkn-0 dist__TextBase-sc-1fnzlkn-3 bYFsJw cuqaEv article-text\">The victim said Feight struck her to the ground and tried to overpower her before she fought back and he fled. Feight was initially charged with battery and attempted sexual battery.<\/p>\n<p class=\"dist__Box-sc-1fnzlkn-0 dist__TextBase-sc-1fnzlkn-3 bYFsJw cuqaEv article-text\">[PAST COVERAGE: Suspect arrested in attack on jogger near Orlando\u2019s College Park]<\/p>\n<p class=\"dist__Box-sc-1fnzlkn-0 dist__TextBase-sc-1fnzlkn-3 bYFsJw cuqaEv article-text\">The state attorney\u2019s office later dropped the attempted sexual battery charge after review by the sex crimes division, which found insufficient evidence to prove Feight\u2019s intent beyond a reasonable doubt. The case was transferred to the general prosecution division, which filed felony battery charges.<\/p>\n<p class=\"dist__Box-sc-1fnzlkn-0 dist__TextBase-sc-1fnzlkn-3 bYFsJw cuqaEv article-text\">On Nov. 20, Feight pleaded no contest to felony battery and was sentenced to 225 days in jail, credited for time served, followed by three years of probation. His probation includes a psychosexual evaluation and treatment, no contact with the victim, and a restriction from returning within three blocks of the incident location. <\/p>\n<p class=\"dist__Box-sc-1fnzlkn-0 dist__TextBase-sc-1fnzlkn-3 bYFsJw cuqaEv article-text\">The victim also approved the plea deal, according to a news release. <\/p>\n<p class=\"dist__Box-sc-1fnzlkn-0 dist__TextBase-sc-1fnzlkn-3 bYFsJw cuqaEv article-text\">Worrell acknowledged the decision to withhold adjudication in the case was legal, but an oversight and violated the office\u2019s normal practice. She emphasized that this did not affect Feight\u2019s sentence or his status as a convicted felon due to a prior case.<\/p>\n<p class=\"dist__Box-sc-1fnzlkn-0 dist__TextBase-sc-1fnzlkn-3 bYFsJw cuqaEv article-text\">\u201cThis sentence was a legal sentence.
