{"id":86004,"date":"2025-12-16T23:38:06","date_gmt":"2025-12-16T23:38:06","guid":{"rendered":"https:\/\/www.newsbeep.com\/us-fl\/86004\/"},"modified":"2025-12-16T23:38:06","modified_gmt":"2025-12-16T23:38:06","slug":"hialeah-teenager-accused-of-fatally-stabbing-his-mother-speaks-out-during-virtual-court-appearance-wsvn-7news-miami-news-weather-sports","status":"publish","type":"post","link":"https:\/\/www.newsbeep.com\/us-fl\/86004\/","title":{"rendered":"Hialeah teenager accused of fatally stabbing his mother speaks out during virtual court appearance &#8211; WSVN 7News | Miami News, Weather, Sports"},"content":{"rendered":"<p>MIAMI (WSVN) &#8211; A 15-year old teenager who was <a href=\"https:\/\/wsvn.com\/news\/local\/miami-dade\/13-year-old-boy-arrested-admits-to-fatally-stabbing-mother-at-hialeah-apartment\/\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">charged in the deadly stabbing of his mother<\/a> made a court appearance Tuesday.<\/p>\n<p>Derek Rosa, who was 13-years-old when he was accused of fatally stabbing his mother over two years ago, appeared virtually where he was asked by the judge presiding over his case if he\u2019s doing OK with his defense team.<\/p>\n<p>\u201cIf you have any difficulty with your lawyers, or you feel that they\u2019re not doing what they\u2019re required to do, and you want me to know about it, please tell them to bring that to you,\u201d said Judge Richard Hersch.<\/p>\n<p>The question came weeks after one of his defense attorneys withdrew from the case. Rosa, however, told Hersch that he had no issues with his representation.<\/p>\n<p>\u201cYour Honor, I would prefer if Ms. Dayliset would speak for me because I trust her with my thoughts,\u201d said Rosa.<\/p>\n<p>Hersch then said he will make a decision soon as to whether Rosa needs a competency determination. <\/p>\n<p>\u201cI am concerned whether I need to order up a competency determination of your client,\u201d said Hersch. \u201cI will address that on [January] 23rd, unto any objections to this court doing so,\u201d he said. <\/p>\n<p>According to police said that Irnia Garcia was stabbed more than 40 times while she was sleeping in her bedroom at their Hialeah apartment in 2023, next to her newborn baby, who was unharmed. Officials say that <a href=\"https:\/\/wsvn.com\/news\/local\/miami-dade\/i-took-pictures-and-i-told-my-friends-about-it-911-call-released-after-13-year-old-kills-his-mom-in-hialeah-apartment\/\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">Rosa called 911 <\/a>and confessed to the crime.<\/p>\n<p>Prosecutors suggest Rosa may have been motivated by horror movies such as \u201cFriday the 13th\u201d and violence, a theory rejected by his defense team. <\/p>\n<p>Rosa has pleaded not guilty to the alleged crimes.<\/p>\n<p>Despite Rosa\u2019s defense team asking for more time to prepare for trial, the judge said the process will move forward and his trial is scheduled for Jan. 26.<\/p>\n<p>Copyright 2025 Sunbeam Television Corp.
