TALLAHASSEE, Fla. \u2013 A new Florida bill filed this week could result in higher fees for homeowners\u2019 associations across the state.<\/p>\n

Another bill \u2014 SB 906<\/a> \u2014 was filed on Monday by state Sen. Ileana Garcia (R-Miami), and it seeks to set up a new state agency: the Office of the HOA Ombudsman.<\/p>\n

The ombudsman would be responsible for helping community association members figure out their rights and responsibilities, as well as monitoring procedures and disputes involving HOA meetings and elections.<\/p>\n

Meanwhile, SB 906 also grants the Division of Florida Condominiums, Timeshares and Mobile Homes more power to oversee HOA activities and ensure compliance with Florida\u2019s regulations.<\/p>\n

However, one of the biggest changes comes in a linked bill, SB 908<\/a>.<\/p>\n

Under SB 908, though, an HOA with over two parcels would be forced to pay the division an annual fee of $4 per residential parcel covered by the HOA.<\/p>\n

If the fee isn\u2019t paid by March 1, the respective HOA would be fined by 10% of the amount due.<\/p>\n

\u201cUntil the amount due, plus any penalty, is paid, the association is deemed delinquent and does not have standing to maintain or defend any action in the courts of this state,\u201d the bill reads.<\/p>\n

If approved during next year\u2019s legislative session, SB 906 would take effect on July 1, 2026. And if SB 908 also gets passed, it will take effect on the same date.<\/p>\n
