{"id":87283,"date":"2025-12-17T22:36:07","date_gmt":"2025-12-17T22:36:07","guid":{"rendered":"https:\/\/www.newsbeep.com\/us-fl\/87283\/"},"modified":"2025-12-17T22:36:07","modified_gmt":"2025-12-17T22:36:07","slug":"texas-florida-sue-fda-over-abortion-pill-approval-2","status":"publish","type":"post","link":"https:\/\/www.newsbeep.com\/us-fl\/87283\/","title":{"rendered":"Texas, Florida sue FDA over abortion pill approval"},"content":{"rendered":"<p class=\"dist__Box-sc-1fnzlkn-0 dist__TextBase-sc-1fnzlkn-3 bYFsJw cuqaEv article-text\">Texas launched a lawsuit against the U.S. Food and Drug Administration last week over the agency\u2019s approval of mifepristone, marking the state\u2019s latest effort to crack down on access to abortion pills. <\/p>\n<p class=\"dist__Box-sc-1fnzlkn-0 dist__TextBase-sc-1fnzlkn-3 bYFsJw cuqaEv article-text\">Joined by Florida, Texas Attorney General <a href=\"https:\/\/directory.texastribune.org\/ken-paxton\/\" rel=\"nofollow noopener\" target=\"_blank\">Ken Paxton<\/a> filed the case on Dec. 9 in federal court in Wichita Falls. The two states argued in a 120-page complaint that the FDA did not properly evaluate mifepristone\u2019s safety and effectiveness when approving the drug in 2000 and its subsequent generic versions. They also challenged the agency\u2019s moves that expanded access to the pills, including the ability to dispense them by mail. <\/p>\n<p class=\"dist__Box-sc-1fnzlkn-0 dist__TextBase-sc-1fnzlkn-3 bYFsJw cuqaEv article-text\">\u201cThe FDA\u2019s regulation of mifepristone was political from the start,\u201d the lawsuit said, pushing for the removal of the drug from the market. <\/p>\n<p class=\"dist__Box-sc-1fnzlkn-0 dist__TextBase-sc-1fnzlkn-3 bYFsJw cuqaEv article-text\">In addition, the lawsuit argues that the<a href=\"https:\/\/www.texastribune.org\/2023\/03\/20\/texas-fda-abortion-pill-comstock-act\/\" rel=\"nofollow noopener\" target=\"_blank\"> Comstock Act of 1873<\/a> prohibits the mailing or delivery of anything intended for producing abortion, which could affect more than just mifepristone. The Biden administration interpreted this law, which has been unenforced for decades, to only cover unlawful abortions.<\/p>\n<p class=\"dist__Box-sc-1fnzlkn-0 dist__TextBase-sc-1fnzlkn-3 bYFsJw cuqaEv article-text\">Mifepristone, when used with misoprostol, is the most common way Americans end their pregnancies. <a href=\"https:\/\/pubmed.ncbi.nlm.nih.gov\/25592080\/\" rel=\"nofollow noopener\" target=\"_blank\">Studies<\/a> have also shown the drug to be<a href=\"https:\/\/www.acog.org\/news\/news-releases\/2025\/05\/leading-medical-organizations-reaffirm-the-safety-of-mifepristone\" rel=\"nofollow noopener\" target=\"_blank\"> safe and effective<\/a>.<\/p>\n<p class=\"dist__Box-sc-1fnzlkn-0 dist__TextBase-sc-1fnzlkn-3 bYFsJw cuqaEv article-text\">The FDA said in a statement that it does not comment on litigation. Abortion access advocates have blasted the lawsuit. <\/p>\n<p class=\"dist__Box-sc-1fnzlkn-0 dist__TextBase-sc-1fnzlkn-3 bYFsJw cuqaEv article-text\">\u201cIf they succeed in restricting access to mifepristone, abortion access will be devastated across the country, even in states where abortion remains legal,\u201d Shellie Hayes-McMahon, executive director of Planned Parenthood Advocates of Texas, said in a<a href=\"https:\/\/www.plannedparenthood.org\/about-us\/newsroom\/press-releases\/its-official-texas-and-florida-still-want-to-ban-mifepristone-nationwide-file-new-lawsuit-in-northern-district-of-texa\" rel=\"nofollow noopener\" target=\"_blank\"> Dec. 10 news release<\/a>. \u201cThis lawsuit is not about safety or health care; it is about control. And nothing short of full control over our bodies will satisfy them.\u201d<\/p>\n<p class=\"dist__Box-sc-1fnzlkn-0 dist__TextBase-sc-1fnzlkn-3 bYFsJw cuqaEv article-text\">Mary Ziegler, a professor and abortion legal historian at the University of California Davis School of Law, said it was not surprising to see this lawsuit. <\/p>\n<p class=\"dist__Box-sc-1fnzlkn-0 dist__TextBase-sc-1fnzlkn-3 bYFsJw cuqaEv article-text\">In recent years, there have been several efforts in the country to legally challenge access to mifepristone \u2014 the new frontier of the fight over abortion access after the fall of Roe v. Wade. They include a case filed in Amarillo, though the U.S Supreme Court<a href=\"https:\/\/www.texastribune.org\/2024\/06\/13\/supreme-court-texas-mifepristone-ruling-abortion\/\" rel=\"nofollow noopener\" target=\"_blank\"> rejected<\/a> it last year and said the plaintiffs didn\u2019t have standing to sue. <\/p>\n<p class=\"dist__Box-sc-1fnzlkn-0 dist__TextBase-sc-1fnzlkn-3 bYFsJw cuqaEv article-text\">There has also been rising frustration among anti-abortion activists about the federal government\u2019s approach, including the FDA\u2019s decision in September to approve a generic version of mifepristone. In response, the agency told<a href=\"https:\/\/www.nytimes.com\/2025\/10\/02\/health\/abortion-pill-generic-fda.html\" rel=\"nofollow noopener\" target=\"_blank\"> The New York Times<\/a> that by law, these applications must be approved if \u201cthe generic drug is identical to the brand-name drug.\u201d <\/p>\n<p class=\"dist__Box-sc-1fnzlkn-0 dist__TextBase-sc-1fnzlkn-3 bYFsJw cuqaEv article-text\">\u201cWhat we\u2019re seeing is Texas is behaving more like Joe Biden as president than you would expect, right?\u201d Ziegler said. \u201cThis is not a situation where Ken Paxton is sitting back and saying, \u2018You know, the FDA is going to make these changes.\u2019\u201d<\/p>\n<p class=\"dist__Box-sc-1fnzlkn-0 dist__TextBase-sc-1fnzlkn-3 bYFsJw cuqaEv article-text\">Texas\u2019 latest mifepristone lawsuit comes days after its <a href=\"https:\/\/capitol.texas.gov\/BillLookup\/History.aspx?LegSess=892&amp;Bill=HB7\" rel=\"nofollow noopener\" target=\"_blank\">House Bill 7<\/a>, which<a href=\"https:\/\/www.texastribune.org\/2025\/08\/22\/texas-abortion-pill-restrictions-lawsuit-manufacturer\/\" rel=\"nofollow noopener\" target=\"_blank\"> allows private citizens<\/a> to sue anyone who manufactures or distributes abortion drugs to or from the state, went into effect.    <\/p>\n<p class=\"dist__Box-sc-1fnzlkn-0 dist__TextBase-sc-1fnzlkn-3 bYFsJw cuqaEv article-text\">Ziegler said these developments reflect the anti-abortion movement\u2019s reliance on the courts to make gains, as there is less political appeal to take on the issue elsewhere in the country compared to Texas. <\/p>\n<p class=\"dist__Box-sc-1fnzlkn-0 dist__TextBase-sc-1fnzlkn-3 bYFsJw cuqaEv article-text\">A federal policy change on mifepristone could also make blue states\u2019 abortion shield laws that seek to protect providers from outside prosecution moot, the professor added.
