{"id":94268,"date":"2025-12-23T23:22:07","date_gmt":"2025-12-23T23:22:07","guid":{"rendered":"https:\/\/www.newsbeep.com\/us-fl\/94268\/"},"modified":"2025-12-23T23:22:07","modified_gmt":"2025-12-23T23:22:07","slug":"orlando-sentinel-sues-state-for-pulse-crosswalk-records","status":"publish","type":"post","link":"https:\/\/www.newsbeep.com\/us-fl\/94268\/","title":{"rendered":"Orlando Sentinel sues state for Pulse crosswalk records"},"content":{"rendered":"<p>The Orlando Sentinel sued the Florida Department of Transportation today, seeking to compel the release of public records related to the state\u2019s decision to remove a rainbow crosswalk outside the Pulse nightclub where 49 people were gunned down almost a decade ago.<\/p>\n<p>The Sentinel requested a variety of documents in late August, but the agency has not produced that information. Nor has it provided substantive updates on the status of the requests, according to the paper\u2019s lawsuit.<\/p>\n<p>\u201cThere is a strong need for the public to understand why the crosswalk was removed and what regulations FDOT believed the crosswalk violated,\u201d Sentinel lawyers Giselle Girones and Rachel E. Fugate\u00a0wrote in the complaint. \u201cAccess to this information will provide critical insight into how FDOT is exercising its regulatory power to eliminate what it considers \u2018political banners,\u2019 especially considering local officials\u2019 claims that the actions were unwarranted and conducted without prior notice.\u201d<\/p>\n<p>An FDOT spokesman did not immediately respond to a request for comment on the filing of the suit.<\/p>\n<p>Florida\u2019s public records law grants broad access to many government records and requires agencies to provide documents within a \u201creasonable time.\u201d The Sentinel\u2019s suit alleges FDOT\u2019s processing time is \u201cunreasonable, unjustified and amounts to an unlawful refusal to provide the records.\u201d<\/p>\n<p>\u201cFlorida has a very broad public records law, and it\u2019s very unfortunate we had to take this step,\u201d said Roger Simmons, Executive Editor for the Orlando Sentinel. \u201cIf we and others do not challenge the state when records requests go ignored, it becomes easier and easier for officials to deny Floridians what statutes and our state constitution promise \u2013 transparency for our government.\u201d<\/p>\n<p>FDOT unexpectedly removed the Pulse rainbow crosswalk overnight on Aug. 20. The move caught local officials by surprise, because the crosswalk had previously been approved by the state. The crossing was painted in 2017, about a year after a gunman opened fire at the gay nightclub in one of the nation\u2019s worst mass shootings. Critics blasted FDOT\u2019s reversal as erasing the memories of those who were killed.<\/p>\n<p>In a statement, FDOT attributed the repainting to new state regulations prohibiting \u201cnon-uniform traffic control devices,\u201d stressing the need to ensure roadways are not used for \u201csocial, political, or ideological interests.\u201d<\/p>\n<p>The Pulse crosswalk wasn\u2019t the only street art targeted by FDOT\u2019s crackdown, which also took issue with racing-themed crosswalks in Daytona Beach, a \u201cBack the Blue\u201d pro-police mural in Tampa, colorful, rainbow pavers in Miami Beach and other unique road markings across the state.<\/p>\n<p>To gain insight into the state\u2019s decision-making process, the Sentinel requested a variety of records related to the Pulse crosswalk, including meeting agendas, studies, correspondence, communications, social media content and work orders.<\/p>\n<p>The first request was made Aug. 21 and has been pending now for over four months.<\/p>\n<p>In October, the Sentinel\u2019s lawyers requested an update on the status of the paper\u2019s public records requests.<\/p>\n<p>An FDOT senior attorney responded that the agency was working on the Sentinel\u2019s request, which he described as \u201cextensive\u201d involving multiple units and staff. He added the request was being handled \u201cin accordance with the requirements of the law,\u201d and the agency was processing hundreds of pending public records requests as promptly as possible.<\/p>\n<p>FDOT\u2019s lawyer attached two documents he said were responsive, a manual of design standards and a memo that had already been made public.
