New York state judges on Tuesday refused to reinstate Freedom Care LLC’s lawsuit claiming the state Department of Health’s process for switching to a single fiscal intermediary to manage home care services throughout the state was rigged.

Freedom Care, which was the largest of over 600 intermediaries in the state before the switch, failed to show the state Department of Health’s decision was illegal or arbitrary and capricious, the New York Supreme Court First Appellate Department said in its unsigned opinion.
