Jan 29 –A man from Honduras
who presented himself at the
US – Mexico border on December
23, 2023 and was given a
notice to appear was detained
by ICE on January 28 while
walking to work in Corona,
Queens.
The next day he
filed a habeas corpus petition
in the US District Court for
the Southern District of New
York, where Inner City Press
found it.Â
 The
petition says is a citizen of
Honduras who was forced to
flee his native country, and
made an I-589 application.
His case was
assigned to Judge Dale E. Ho,
who ordered he not be removed
from the US, SDNY, EDNY or
DNJ, set a Feb 24 hearing with
petitioner produced – and
asked for a letter on January
29 how this is different than
his other cases.
Release is
predicted.
 The case is
Flores Banegas v. Francis, et
al., 1:26-cv-783 (Ho).
