STATEN ISLAND, N.Y. — Sexually explicit videos involving a 4-year-old girl and an adult male were discovered in a cell phone a Staten Island man donated to friends, presumably unaware the images were still accessible, federal prosecutors allege.

The defendant, Jon Consiglio, 39, was arraigned Jan. 28 in Brooklyn federal court on a charge of sexual exploitation of a minor, court records show. He was ordered held without bail.

Consiglio’s attorney, Samuel Jacobson with the Federal Defenders, declined to comment on Monday.

If convicted of child sexual exploitation, the defendant is facing a mandatory minimum of 15 years in prison and a maximum of 30 years.

Images discovered in cell phone: Feds

In November 2025, Consiglio gave one of his phones away to a friend’s girlfriend, authorities allege in court documents.

In January, the friend’s girlfriend passed the device on to a relative because she didn’t need it anymore, according to the criminal complaint.

The relative reported to police that she found two videos in the phone showing an adult man engaged in oral sex and intercourse with the child, the complaint alleges.

One video was more than three minutes long and the other was more than four minutes, according to prosecutors.

FBI launches investigation

Within days of the phone being turned over to police, members of the Child Exploitation and Human Trafficking Task Force — a joint effort involving the FBI and NYPD — interviewed the three individuals who handled the phone after the defendant.

The individuals all recognized the girl in the video, and said the voice of the man in the video sounded like Consiglio, according to federal investigators.

A person known to the defendant then provided images of Consiglio’s bedroom to compare with the videos. Hand tattoos visible in the videos matched images on the defendant’s social media page, authorities said.

The girl’s mother was made aware of the images the night prior to the defendant’s arraignment, Assistant U.S. Attorney Jack Dennehy noted during court proceedings, the Daily News reported.
