The New York State Police are investigating a car crash in the Town of Batavia that left one man dead.

According to a spokesperson for the New York State Police, on February 12, shortly before 3pm, troopers responded to West Main Street and Kelsey Road for a vehicle crash. During the initial investigation, troopers determined a 1983 Mercury Marquis was headed eastbound on West Main Street before it crossed the center line and struck a 2013 Toyota 4-Runner.

The driver of the Marquis, Thomas J. Luby, 79, was transported to Erie County Medical Center with life-threatening injuries. Troopers say Luby died at the hospital while being treated.

The driver of the 4-Runner reportedly had no injuries.

The New York State Bureau of Criminal Investigation is assisting with the ongoing investigation.
